Community Development Director Frolik responded there is a paved road adjacent to a private <br />road. She noted the Finding of Fact talks about a public facility and not a private driveway. <br /> <br />Councilmember Anderson stated with regard to Finding of Fact #16, allowing a commercial use <br />without a residence would be detrimental to community property. <br /> <br />Motion by Councilmember Anderson and seconded by Councilmember Connolly to amend <br />Finding of Fact #16 by deleting "and will not be detrimental to the economic welfare of the <br />community." <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Connolly, Hendriksen, <br />and Zimmerman. Voting No: None. Absent: None. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Connolly to add as <br />Finding of Fact #18, "That the expansion of a non-conforming commercial use may be an <br />economic detriment to the community by citing a commercial enterprise in a residential zone." <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Connolly, Anderson, <br />and Zimmerman. Voting No: None. Absent: None. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Connolly to amend <br />Finding of Fact #11 to replace "will" with "may" before "change." <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Connolly, <br />Anderson, and Hendriksen. Voting No: None. Absent: None. <br /> <br />Motion by Councilmember Hendriksen and seconded by Mayor Gamec to adopt Resolution #00- <br />05-130 adopting Findings of Fact # 0523 relating to the request for a conditional use permit to <br />operate a woodworking business in a residential district, as amended. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Anderson, Connolly, <br />and Zimmerman. Voting No: None. Absent: None. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Anderson to deny the <br />request for a conditional use permit from Mr. Chris Barrett based on the findings of fact. <br /> <br />Further discussion: Mr. Menard asked if the Council is aware that the City has assigned this <br />parcel a separate address. Mayor Gamec responded he could not prove Mr. Menard right or <br />wrong. He stated there is no permit so it is not clear how the building got there. Mr. Menard <br />stated if Mr. Barrett is allowed to expand, he could build his business to one day occupying a <br />commercial space. He asked why it is denied when none of the neighbors object. Mayor Gamec <br />responded it is a commercial use in a residential zone.
