Motion carded. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Anderson, Connolly, <br />and Zimmerman. Voting No: None. Absent: None. <br /> <br />Mayor Gamec declared a recess at 9:39 p.m. The meeting reconvened the meeting at 9:49 p.m. <br /> <br />Case # 12B: Request For a Conditional Use Permit to Grade and Export Soils; Case Of <br /> Eric Thomsen. <br /> <br />Community Development Director Frolik advised that the City has received a new application <br />from Eric Thomsen to grade and export soils from an area generally located west of T.H. #47 and <br />south of County Road #63, at about Vanadium Street N.W. The subject property consists of nine <br />acres. The City Council originally approved a conditional use permit for grading and exporting <br />of soil from this property on March 25, 1997. The applicant did not initiate the conditional use <br />permit within the three-year timeframe, nor did he petition for an extension of time to complete <br />the grading and exporting of soils. The applicant would like a re-issuance of the conditional use <br />permit. Conditional Use Permits are required to be subjected to public heatings with all <br />properties within 350 feet being notified of the public hearing. The Anoka County Highway <br />Department was also notified of the conditional use permit application. The Planning <br />Commission held a public hearing at the May 2, 2000 meeting. There was no public input during <br />the public hearing. City Staff and Planning Commission recommends approval of the permit <br />contingent upon the following conditions: <br /> <br />A like number of trees being planted to replace the removed trees. The trees should be a <br />minimum of 1-1/2 inches in diameter and be of similar species to those removed. <br />The Grading Plan being modified to show the extent of the excavation phasing and the <br />topsoil stockpile area. <br />That the clean fill requested for importation is limited to topsoil for restoration purposes. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Hendriksen to adopt <br />Resolution #00-05-131 adopting Findings of Fact #0524 relating to the request for a conditional <br />use permit to grade and export soils. <br /> <br />Further discussion: Councilmember Anderson asked why this conditional use permit had a <br />timeline. Community Development Director Frolik responded there is a timeline because there <br />is a resource that could be depleted. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Hendriksen, <br />Anderson, and Connolly. Voting No: None. Absent: None. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Connolly to approve <br />the request for a conditional use permit based on the findings of fact, and adopt Resolution 00- <br />05-132 declaring the terms of same. <br /> <br />City Council/May 23, 2000 <br />Page 29 of 36 <br /> <br /> <br />
