Motion by Councilmember Connolly, seconded by Mayor Gamec, to adopt Ordinance #00-08 to <br />rezone certain property from B-1 and B-2 Business to Planned Unit Development. <br /> <br />A roll call vote was performed by the recording secretary. <br /> <br />Councilmember Hendriksen aye <br />Councilmcmbcr Anderson aye <br />Councilmember Connolly aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case #9: <br /> <br />Request for Final Plat Approval of Mallard Ponds; Case of Chris Bulow, <br />Bulow Incorporated <br /> <br />Community Development Director Frolik stated that Chris Bulow of Bulow, Inc. is requesting <br />final plat approval of Mallard Ponds. The plat consists of approximately 16 acres proposed to be <br />platted into 94 townhome lots and one commercial outlot. The commercial' outlot is a replat of <br />Outlot L in Flintwood Hills 2nd Addition. The outlot was approved for commercial development <br />as part of the Flintwood Hills 2"d Addition Planned Unit Development (PUD) and that will be <br />reaffirmed in the development agreement for Mallard Ponds. The approved preliminary plat <br />proposal is to develop the northern portion of the property with 58 townhome units (26 detached <br />townhomes and 32 twinhome units); and the southerly portion of the property would be <br />developed with 36 quadhome units (nine four-unit structures). The City Council granted <br />preliminary plat to the applicant on May 23, 2000. The City Council also introduced an <br />ordinance to rezone the property from B-1 and B-2 Business to PUD. The final adoption of the <br />ordinance took place earlier in the meeting. Public access to the plat will be derived from a cul- <br />de-sac extension off of Dysprosium Street NW. The final plat must be corrected to name the cul- <br />de-sac 140th Avenue NW. All interior streets will be private. Argon and Barium to the north will <br />not be extended into the plat. Outlot L will be given a lot and block number. There will also be <br />a fight-in/right-out on County Road #116. The minimum lot size for the detached townhomes is <br />3,900 square feet 3,300 square feet per unit for the twinhomes; and the quadhome lots range from <br />2,000 to 2,700 square feet each. All of the units contain a minimum of 800 square feet of <br />finished living area. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Connolly, to adopt <br />Resolution #00-06-150 granting final plat approval to Mallard Ponds contingent upon <br />compliance with City Staff Review Letter dated June 8, 2000 and the Developer entering into a <br />Development Agreement with the City. <br /> <br />Motion carded.
