regard to the density transition ordinance, the ordinance would eliminate any development on the <br />Katnis property other than one unit per half acre. <br /> <br />Motion by Councihnember Zimmerman, seconded by Councilmember Hendriksen, to table <br />action until the proposed Comprehensive Plan is returned from the Metropolitan Council. <br /> <br />Further discussion: Councilmember Hendriksen inquired if the correct action is to table the <br />request or to deny the request at this time. City Attorney Goodrich replied that the Council <br />should either table action on the moratorium exception or take action, but not table action until <br />the Comprehensive Plan is returned. He also noted that if the Council were to deny the request at <br />this time they would still have the authority to take the property out of the moratorium at any <br />time. <br /> <br />The motion was removed from the floor. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to adopt <br />Resolution #00-07-183 adopting Findings of Fact # 0528 relating to a request for an exception to <br />the development moratorium. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, and <br />Connolly. Voting No: None. Absent: CouncilmemberAnderson. <br /> <br />Motion by Councilmen~ber Zimmerman, seconded by Councilmember Hendriksen, to deny the <br />request fi'om Marlene Katnis and Orrin Thompson Homes to except the property at 14660 St. <br />Francis Boulevard NW from the moratorium based on the findings of fact. <br /> <br />Motion carried. Absent: CouncilmemberAnderson. <br /> <br />Case #3: <br /> <br />Request to Rezone Certain Property from R-1 Rural Residential to R-1 <br />Urban Residential; Case of Reilley Estates Partnership, Inc. <br /> <br />This iteln was removed from the agenda. <br /> <br />Case #4: <br /> <br />Adopt Ordinance Amending Section 4.80 of the City Code, which Section <br />4.80 is Entitled "Storm Drainage Utility" <br /> <br />City Engineer Olson stated that on November 23, 1999, the City Council introduced an <br />ordinance creating a storm drainage utility. The utility was adopted on January 11, 2000. On <br />June 27, 2000, the City Council adopted a resolution establishing the storm drainage utility fees <br />by amending the 2000 schedule of rates, fees, and charges. On July l 1, 2000, the City Council <br />introduced the ordinance and it has been posted since that time at City Hall. The changes <br />required of the ordinance are clerical in nature and are needed to ensure clarification of the <br />existing ordinance.
