<br /> TO WHOM IT MAY CONCERN:
<br /> THIS IS NOT A BILL-DO NOT PAY! Notice
<br /> is hereby given that the Ramsey City Council
<br /> will meet at 7:00 p.m., Tuesday, September 26,
<br /> '2000, to pass upon the proposed assessment
<br /> for Improvemen_t Project//00-02, which is the
<br /> Bituminous Overlay Ramsey Terrace.
<br /> The amount to be specially assessed
<br /> against any particular lot, piece or parcel-rof
<br /> land is $575.80. Affected property owners-fBay,
<br /> at any time between September 27 .and
<br /> November 3, 2000 (prior to certification of the
<br /> assessment to the Anoka co~lnty Auditor), pay
<br /> the.~ntire.assessme'nt 9n .such property with
<br /> 'interest accrued to thedate of payment,.to the
<br /> City. of Ramsey. No interest shall.be charged if
<br /> the entire assessment is paid within 30 days
<br /> from the'adoption of the assessment,, which is
<br /> anticipated to be September 26, 200'0.
<br /> Affected pr.qp.e_r~ty. O.WO.ers~JOay,.at any time
<br /> thereafter pay to the City of. Ramsey the entire
<br /> amount of. the assessment remaining unpaid,
<br /> with interest accrued to Decembe~ 31 of the
<br /> next succeeding year. if. an affected property
<br /> owner decides not to prepay, the assessment
<br /> before the date given above, ~the rate of'inter-
<br /> est that will apply is 8.$ percent per year: The
<br /> right to partially prepay the assessment is not
<br /> available.
<br /> The proposed assessment roll is on file ior
<br /> public inspection at the City Administrator's
<br /> office. The total amount of the proposed
<br /> assessment is $,575.80. Written or oral objec-
<br /> tions will be considerec~ at the hearing. No
<br /> appeal may be taken as to the amount of an
<br /> assessment unless a signed,, written objection
<br /> IS filed with the City Administrator prior to the
<br /> · hearing or presented to-the presiding officer at
<br /> the hearing. The City Council may upon such
<br /> notice consider any objection to'the arhount of
<br /> a proposed, individual assessment at an
<br /> adjourned nearing upon such further notice to
<br /> the affected property owner~ as it deems
<br /> advisable:
<br /> If a n assessment is ~ontested or there is an
<br /> adjourned hearing, the following procedure
<br /> will be followed:
<br /> 1) Yhe City will present its ca~e first by
<br /> : calling witnesses who may test[fy by
<br /> ' .narrative or by examination, and by the
<br /> .introduction,of exhibits. After such wit-
<br /> : ness nas testified, the contesting party
<br />
<br /> will be allowed to ask questions. This
<br /> procedure will be repeated with each
<br /> witness until neither side has further
<br /> questions.
<br /> 2) After the City has presented all its evi-
<br /> deni:e, the objector .may, call witnesses
<br /> pr pre~ent such testimony a~ the obiec-
<br /> tot desires, The same procedure for
<br /> questioning of the City's witnesses will
<br /> be followed'with the obiector's wit-
<br /> nesses.
<br /> 3) The objector may be represented by
<br /> counsel. ' '
<br /> 4) Minnesota Rules of Evidence will not
<br /> be strictly applied; however, they. may
<br /> be considered and.argued, to. the
<br /> Council as to the weight of items of, evi-
<br /> dence or testimony presented to.the
<br /> C~uncil. - "
<br /> $) The entire oroceedings, will be record-
<br /> ed.
<br /> 6) .At the close of the presentation of evi-
<br /> ~ dence, the objector may make a final
<br /> ,. presentation to. the Council based.on
<br /> · the evidence and the law. No new evi-
<br /> - dence may. be presented at.this point.

<br /> Under Minnesota Statutes, Sections 435.193,
<br />to. 435.195, ~nd Ramsey City Code Ch'apter
<br />4.60:18, the City Council may defe? the pay-
<br />ment of this special a~sessment for any per-
<br />son(s) that fit the guidelines listed in Section
<br />4.60.18 Subd. 5 of the Ramsey City Code.
<br />When a deferment of the special assessment
<br />has been granted and is terminated for any
<br />reason provided in these' laws, all amounts
<br />accumulate% including applicable interest,
<br />will be due: Any assessed property owner
<br />m. eeting the reqmrements of these laws may,
<br />within 30 days of the confirmation of the
<br />as'sessment, apply to the City Administrator
<br />with the prescribed form for such deferral of
<br />payment'of this special 'assessment·
<br /> .An owner may appeal an assessment to
<br />District Court pursuant to Minnesota Statutes
<br />Section 429.081 and Chapter 4.60.10 of the
<br />Ramsey City Code by serving notice of the
<br />appeal upon the Mayor or City Administrator
<br />-of the City within 30 days after the adoption of
<br />the assessment and filing_such notice with the
<br />District Court within ten da'ys after.serwce
<br />upon the. Mayor or City Administrator.
