<br /> THIS IS NOT A BILL--DO NOT PAY! Notice
<br /> is hereby given that' the Ramsay City Council
<br /> wiU meet at 7:00 p.m., Tuesday, September 26,
<br /> 2000, to pass upon.the proposed assessment
<br /> for Improvemept Project #00-03, which is the
<br /> Bituminous Overlay Rum Acres Estates.
<br /> The amount to be specially assessed
<br />against any. particula'r lot, piece or parcel of
<br />land is $477.40. Affected prope~y owners.may,
<br />at any time between September 27 .and
<br />Novembbr 3, 2000 (prior to certification of the
<br />assessment to the Anoka County Auqitor), pay
<br />.the-entire assessment' on ~uch property With
<br />interest accrued to the date of payment, to the
<br />City of Ramsay. No interest shall be charged, if
<br />the entire assessment is paid within 30 days
<br />,from.the adoption of. the assessment, which is
<br />~anti¢ipated to be September 26, 2000.
<br /> Affected property owners ma~, at any time
<br />: thereafter pay to the City of Ramsey the entire
<br />amo~int of the assessment remaining unpaid;
<br />.with interest accrued, to December 31, of-the
<br />; next succeeding year. If an affected property
<br /> owner decides not to prepay the assessment
<br /> · before the date given above, the rate of inter-
<br /> est that.'will apply'is 8.S percent-per year. The
<br />"right to part ally prepay the assessment is not
<br /> available. '
<br />: .The proposed, assessment roil is on file for
<br />t public inspection at the City Administrator's
<br />office; The total amount of the proposed
<br />:assessment is $'477.40. Written or oral obje¢-
<br />· tions will be considered~ at the hearing. No
<br />~ appeal may be'taken as to the amount'of an
<br />:assessment unless a signed; written obiection
<br />: is filed with the City. Adminis~trator prior to the
<br />hearing or presented to the presiding officer at
<br />'he hearing. The City Council' may upon such
<br />torito, consider any 6biection to the amount of'-'
<br />a proposed individual assessment at an
<br />: adjourned hearing u pon such ~Jrther n0ti~:e to
<br />the affected property owners, as it deems
<br />advisable. - . - .....
<br /> If an: assessment is contested or there is.an
<br /> adjourned hearing; the followifig procedure
<br />. Will.be followed:
<br /> '1)' The City will p~'esent its case first by
<br /> ~ : coifing witnesses who may testify by
<br /> narrative or by examin~,tion, and by the
<br /> introduction of exhibits. After such wit-
<br /> _ ness has testified, the contesting party
<br />
<br /> will be allowed to ask 'questions. This
<br /> .procedure will be. repeated with each
<br /> witness until .neither side has further
<br /> questions.
<br /> 2) After the City has presented all its evi-
<br /> dence, the objector.may call witnesses
<br /> or present such testimony as the objec-
<br /> tor desires.. The same procedure for
<br /> questioning of the City~ witnesses wi[[
<br /> be followed with the objector's.wit-
<br />
<br /> 3) The objector may be represented' by
<br /> counsel. '
<br /> 4) Minnesota Rules Of' Evidence will not
<br /> be strictly applied; however, they may
<br /> be considered ahd argued to the
<br /> Council as to:the weight of items of evi-
<br /> dence or testimony presented'to the
<br />
<br /> 5) The entire proceedihgs will be. record-
<br />
<br /> 61 At the close of the presentation of evi-
<br /> dence~ the obiector may make a final
<br /> presentation-to the Council based on
<br /> ' the evidence and the law. No new evi-
<br /> dence may be presentedat this point.
<br /> 7) .The council may adopt the proposed
<br /> assessment at the hearing.
<br /> Under Minnesota Statutes, Sections 435.193
<br />to 435.195, and Ramsay City Code Chapter
<br />4.60.18, the City Council may defer the pay-
<br />ment of this special assessment for any per-
<br />son(s) that fit the guidelines listed, in Section
<br />4.60.18 Subd. 5 of the Ramsey City Code.
<br />When a deferment of the special assessment
<br />has been granted and is terminated for any
<br />reason provided in these laws, ali.amounts
<br />accumulated, including applicable interest,
<br />will. be due. Any assessed property owner
<br />meeting the requirements of these laws may,
<br />within 30 days of the confirmation of. the
<br />assessment, apply to the City Administrfitor
<br />with the prescribed form for.such_deferral of
<br />payment of this special'assessment. ' .
<br /> An owner may appeal an assessment to
<br />District Court pursuant t? Minnesota Statutes
<br />Section 429.081 and Chapter 4.60.10 of the
<br />Ramsey City Code by-serving notice of the
<br />appeal upon the Mayor or City Administrator.
