<br /> THIS IS NOT A BILL-DO NOT P~,Y! Notice
<br />-Is hereby given that the Ramsey City Council
<br />· will meet at 7:00 p.m., Tuesday, September 26,
<br />2000, to pass upon the proposed assessment
<br />, for Improvement Project #00-04, which is the
<br /> Bituminous Overlay Crow's· Unplatted.
<br /> The amount to be specially assessed
<br /> against any particular loin, piece or parcel of
<br /> land is $540.40. Affected property owners.
<br /> may, at any time between September 27 and
<br />_ November 3, 2QO0 (prior.to c~rtification of the
<br />-:,~ssessment to the Anoka County Aud toO,' pay
<br />· the entire assessment on' such property with
<br />' interest accrued·to the date of payment, to the
<br />City of Ramsey. No interest shall be charged if
<br />the entire assessment is paid within 30 days
<br />,from.the adoption of. the assessment, which is

<br />est that will apply is 8.5 percent per year. The
<br />· right to partially prepay the. asse'ssment is not
<br />available.
<br /> The proposed.assessment ?oll is on file for
<br />public inspection at the City Administrator's
<br />office..'rhe tota amount of the proposed
<br />assessment is $540.40. Written or oral-'obtec-
<br />tions will be. cons!tiered at the hearing. No
<br />· appea may. be taken as to the amount of an
<br />assessment unless a signed, written objectibn
<br />.. is. filed with the. City Administrator prior' to the
<br />, hearing or presented to the presid!ng:off.icer'at
<br />:the hearing.. The.. City Council may~ upon such
<br />notice consider-any objection to the amount of
<br />'a proposed individual assessment at an
<br />adjourned hearing upon such 'further notice.to
<br />the affected property owners a.s it deems
<br />advisable, - -
<br /> If an assessment is contested or there is an
<br /> adjourned hearing; the following procedure
<br /> ~gill be followed:
<br /> 1) The City will present its case first by
<br /> calling wit'nesses who may testify by
<br /> narrative or'by examination, and by the
<br /> introduction of exhibits. After such wit-
<br /> ness has testified, the contesting party
<br />
<br /> wil be allowed to·ask questions. This
<br /> procedure will be repeated with each
<br /> 'witness until neither side has further
<br /> questions. -
<br /> 2) After the City has, presented all its evi-
<br /> dence, the objector may call witnesses
<br /> or present_such testimony a~ the objec-
<br /> tor desires. The same.procedure for
<br /> questioning of the City's witnesses will
<br /> be followed with th~ objector's wit-
<br /> nes~es.
<br /> 3) The objector may be represented by
<br /> counsel.
<br /> 4) Minnesota Rules of. Evidence will not
<br /> be strictly applied;'however, they may.
<br /> be considered and argued to the
<br /> Council as to the weight of items of evi-
<br /> dence or testimony presented to the
<br /> C~unci[. . - ~
<br /> S) The entire proceedings will,be record-
<br /> ed.
<br /> 6) At the clos~ of the presentation of evi-
<br /> dence, the objector may make-a final
<br /> presentation, to the Council [based on
<br /> the e~idence, and the law. No flew evi,
<br /> dence may be presented'at this point,
<br /> 7) The council may adopt~the prop'ose'd
<br /> assessment at the hearing.
<br /> Under Minnesota Statutes, Sections 435.'193
<br />to 435.195, and. Ramsey. City Code Chapter
<br />4.60.18, the City Council may defer the pay-
<br />ment of this special assessment fbr any per-
<br />son(s) that fit the guidelines listed in Section
<br />4.60.18 Subd. 5 of the Rams.ey City Code.
<br />When a deferment of the specia assessment
<br />has been granted and'is terminated for any
<br />reason provided in these !aws, all amounts
<br />accumulated, including applicable interest,
<br />,will be due. Any a, ssessed property owner
<br /> meeting the requirements of these laws may,
<br /> within 30 days of the confirmation of the
<br /> assessment, apply to the City Administrator
<br /> with the prescribed'form for such deferral of'
<br /> payment .of this· special assessment.
<br /> An owner 'may' appeal an assessment to
<br />District Court pursuant to Minnesota. Statutes
<br />Section 429.081. and Chapter 4.60.10- of the
<br />Ramsey City Code by serving notice of the,
<br />.appeal upon the Mayor or City Administrator
<br />of the City within 30 daysafter the adoption of
<br />the assessment and. filing such notice with the
<br />District Court within ten days after service
