Councilmember moved for the adoption of the following fmdings of fact: RESOLUTION #06-02- A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A REQUEST FOR A CONDITIONAL USE PERMIT FOR A 195-FOOT SELF- SUPPORTING LATTICE-STYLE COMMUNICATIONS TOWER. WHEREAS, Anoka County, hereinafter referred to as "Applicant", has properly applied for a Conditional Use Permit to construct and operate a lattice-style communications tower ("Tower") on the property generally located south of Alpine Drive NW and east of Nowthen Boulevard NW and legally described as follows: Lot 2, Block 1, Holasek's Addition, Anoka County, Minnesota (the "Subject Property"). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That the Applicant appeared before the Planning Commission for a public hearing pursuant to Section 9.03.05 of the Ramsey City Code on February 2, 2006, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 2. That the Subject Property is located in the p-Public/Quasi Public District, is approximately 23 acres in size, and is owned by the City of Ramsey. 3. That the Applicant is requesting that the City provide an eighty (80) foot by eighty (80) foot portion of land on the Subject Property (Site) to facilitate the construction and operation of the Tower. 4. That the property to the east and south are zoned R-I MUSA, the property to the north is zoned R-2 Medium Density Residential, and the property to the west is zoned B-1 Business. That City Code restricts tower heights to 120 feet, 165 feet, and 175 feet in residential, commercial, and industrial districts, respectively, but does not specify a maximum tower height in the Public/Quasi Public district. That the use of Public/Quasi Public lands is generally most comparable to that of commercial lands. That City Code states that the City Council may permit a greater tower height if it is demonstrated to their satisfaction that surrounding topography, structures, vegetation or other factors make the height limit for a complying tower impractical. That City Code requires commercial wireless telecommunication service towers to be of a monopole design unless the City Council determines that an alternative design is preferred in cases where structural or design considerations, neighborhood compatibility, locational availability, or the number of potential co-locations warrants this consideration. -278-
