REPORT FROM PUBLIC WORKS
By: Public Works Staff

Background:
The Public Works Committee met on Tuesday, January 17, 2006 and discussed the following
seven cases:

CITIZEN INPUT
Dan Murphy, 5600 150~ Lane in Pondvale Estates, stated there was trouble trying to get sewer
and water in his neighborhood in the past. However, there will be a new development where
the existing City Hall is currently located', and Helium Street will run up to Alpine Drive. The
extension of Helium Street was the big issue in getting the sewer and water to go thxough the
last time. He stated the City offered an excellent opportunity for the sewer and water last
time, but it did not work out. Mr. Murphy distributed a petition in favor of a sewer and water
project in Pondvale Estates. He stated the property owners of Lot 2 signed an agreement when
they purchased the house that requires them to remain neutral on any proposed City water and
sewer projects. He requested the City to look at this request again, possibly due to drainage or
road issues, and explained there will be another 11 to 13 lots opened in the area. Staff replied
in 1993 there was a feasibility study for sewer and water put together that was counter-
petitioned and the project was blocked. In 2001 the discussion was started at the Public Works
Committee, and the Council then directed staff to look into this area more regionally. At that
point three separate feasibility studies were drafted. There were counter-petitions and the
project has not been discussed since. Staff advised since the City has put significant funding in
the feasibility for both ceighborhoods, nothing of which was reimbursed, that the City would
not move forward with another project like this until there was a request and staff advises this
petition should be forwarded to the City Attorney to be sure it is correct as to form. Support
of more than 35% of the property owners is required by City Code to require a feasibility
study.

Motion to accept the petition contingent on City Attorney review.

Action:

Ratify the recommendation of the Public Works Committee.

Case #1 Consider Establishing Process for Subdivision Street Lighting Requests

Background:
Periodically staff receives inquiries from the public on the process for getting street lights
installed in areas currently without them. Staff has advised such inquiries that a petition to the

-319-
