Further discussion: Councilmember Hendriksen inquired as to how long do they delay the issue. <br />Mayor Gamec replied that he has a real problem with the January 3rd date without having a good <br />legal opinion. <br /> <br />Motion failed. Voting Yes: Mayor Gamec, and Councilmembers Anderson. Voting No: <br />Councilmembers Connolly, Hendriksen, and Zimmerman. <br /> <br />Original Motion carried. Voting Yes: Councilmembers Hendriksen, Connolly, and <br />Zimmerman. Voting No: Mayor Gamec and Councilmember Anderson. <br /> <br />Motion by Councilmember Anderson, seconded by Mayor Gamec, to continue working on the <br />Density Transition Ordinance as drafted. <br /> <br />Further discussion: Councilmember Hendriksen stated that he personally believes there was a <br />good ordinance already drafted and wished that Councilmember Anderson would have <br />participated in drafting the ordinance, which may have avoided all of this. He stated that he <br />would be willing to continue working on the ordinance if the previous motion does not move <br />forward. <br /> <br />Motion carried. Voting Yes: Mayor Gamec and Councilmembers Anderson, Connolly, <br />Hendriksen, and Zimmerman. Voting No: None. <br /> <br />Case #2: Introduce Ordinance to Amend Park Dedication Requirements <br /> <br />Community Development Director Frolik stated that currently City Code requires park <br />dedication in the form of cash or Im:d or a combination thereof when property is subdivided. <br />There is the potential for development to occur on property and no subdivision may be required. <br />For instance, it is possible that there could be a multi-family rental development that would not <br />require subdivision of the property. Under the current subdivision regulations, the City would <br />not have the opportunity to obtain park dedication when no subdivision is required. Based on <br />conversations with a couple of other communities, staff has drafted an ordinance that would <br />require subdivision on all developments, even if subdivision of property is not required. The <br />Planning Commission reviewed the Ordinance on December 5, 2000. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Connolly, to introduce an <br />ordinance to require park dedication on development projects that do not require subdivision of <br />land. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Connolly, <br />Anderson, and Hendriksen. Voting No: None. <br /> <br />City Council/December 19, 2000 <br /> Page 13 of 19 <br /> <br /> <br />
