starts, and that the motion made will serve to defray that group's legal .expenses, and that motion <br />may put the City in a position of advising this group, which may limit the City's courses of <br />action following this advise, and because Mr. Hendriksen is a member of that group and fitlly <br />supports their actions with the use of his personal and other business related services, has caused <br />a conflict of interest. It is strongly felt that because Mr. Hendriksen has been in the past, and still <br />is the person who currently presses these issues to the fullest against other parties, that the City <br />Council should forward this letter of citizen complaint, and a copy of the video tape of the <br />meeting, to the proper legal attthority to determine if a conflict does exist. I would also suggest <br />that Council person Connolly should abstain from any action on this complaint, because of her <br />strong personal ties to this same group." <br /> <br />Councilmember Hendriksen stated that "it is an old technique to raise a straw horse that is <br />accurate and then knock it down." He stated that the Charter currently lacks the specificity <br />necessary to create a petition and he knows absolutely that it meets the criteria that would be <br />demanded of it and for that reason he requested that the City Attorney review it, from a format <br />standpoint only, prior to circulation. Since the petition would have to be reviewed by the City <br />Attorney it would not incur any further expenses to the City. <br /> <br />Motion by Councihnember Hendriksen, seconded by Councilmember Zimmerman, to readdress <br />Case #12 fi'om the December 12, 2000 City Council meeting regarding the Adoption of the <br />Density Transition Ordinance. <br /> <br />Motion can'ied. Voting Yes: Councilmembers Hendriksen, Zimmerman, and Cmmolly. Voting <br />No: Mayor Gan'mc, and Councilmember Anderson. <br /> <br />Councilmember Connolly noted that she is not a member of the Reilley Estates neighborhood <br />group and does not live in that area, but she does agree with their viewpoints. She does not think <br />she should have to abstain from voting for that reason. <br /> <br />Kerry Manuel, 15668 Juniper Ridge Drive NW, Ramsey, stated that no one on the City Council <br />is a member of their neighborhood group. <br /> <br />APPROVE AGENDA <br /> <br />Mayor Gamec requested that Case #9 Accepting Proposals on the Sale of General Obligation Tax <br />Increment Bonds, Series 200lA and 200lB be moved up as Case A. <br /> <br />Councih-nember Hendriksen requested that they add Case B to return to the discussion of the <br />Density Transition Ordinance. <br /> <br />City Administrator Norman noted that Case #10 should be removed from the agenda and a new <br />Case #9, Adopt Resolution Approving Appraisal for Acquisition of Makens Property, should be <br />added to the agenda. <br /> <br />City Council/December 19, 2000 <br /> Page 3 of 19 <br /> <br /> <br />
