Mr. Johnson replied that the neighborhood agreement is many months olds and, subsequent to <br />the neighborhood meetings, they have had discussions with City staff and, based on those <br />discussions, they changed one of the group homes into four units. <br /> <br />City Attorney Goodrich stated that he had reviewed the development agreement and noticed <br />some inconsistencies and for that reason he suggested that the motion to execute the development <br />agreement be made contingent upon his review and approval. <br /> <br />Mayor G amec inquired if the sale of the land was contingent upon the approval of the project. <br /> <br />City Attorney Goodrich explained that the purchase agreement was drafted in 1999, and indicates <br />that the agreement is contingent upon the City and the developer entering into a development <br />agreement. He also noted that the original purchase agreement did not have any reference to <br />creating a TIF District. <br /> <br />Councilmember Anderson inquired if all the documents were in order. <br /> <br />City Attorney Goodrich replied that the City can enter into the agreement, but there are numerous <br />problems with the language that he would like to make changes to. <br /> <br />Councihnember Anderson stated that the Council is being asked to execute a development <br />agreement that references a TIF District, and questioned if the Council should be addressing the <br />issue of the TIF District first. <br /> <br />City Attorney Goodrich replied that the TIF District would have to be properly established to <br />make the document legally binding. <br /> <br />Councihnember Anderson inquired if the City Attorney would be more comfortable if the <br />Council dealt with the development agreement by itself or waited until everything is in place. <br /> <br />City Attorney Goodrich replied that the Council can act on the development agreement subject to <br />his approval, but noted that a lot has to come together before he would give his legal approval. <br /> <br />Mayor Gamec inquired if the sale would be for the property zoned R-3 or would it still be for the <br />entire parcel. <br /> <br />City Attorney Goodrich replied that the agreement deals with the entire parcel as it is cm-rently <br />zoned. He noted that ACCAP accepts that condition. <br /> <br />Mr. Johnson stated that ACCAP's goal is to execute the sale of the land. He explained that if the <br />City can come to an agreement on the sale of the land this year without entering into a <br />development agreement that would be acceptable to ACCAP as well as a development agreement <br />approval that is subject to legal approval. <br /> <br />City Council/December 12, 2000 <br /> Page 8 of 25 <br /> <br /> <br />
