Councilmember Hendriksen stated that he appreciates that Mr. Gruber has taken the time to do <br />the research and thanked him for the way he presented the information to the Council. He stated <br />that he agreed with making the credit retroactive. <br /> <br />Mr. Gruber noted that in order to qualify for the modified method, the property needs to be less <br />than 20 acres and less than 10 percent impervious so even if the acreage was reduced from 20 <br />acres he would still not qualify for the modified method. Thus, the amount of impervious area <br />should also be reduced. <br /> <br />City Engineer Olson noted that when the impact fee was originally collected, the intent was to <br />provide outlets to the Rum River and those projects were quite expensive. Since 1996, the City <br />has collected approximately $160,000 from the impact fee and this is something the Council <br />needs to address because it is two separate funding sources. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Anderson, that the 2000 <br />schedule of rates and charges for the storm water utility established by Ordinance #00-01 be <br />those rates and charges as adopted by Council Resolution #00-06o165 and which charges are <br />payable in quarterly installments with the full and final payment being due on or before <br />December 31, 2000, and each December 31 thereafter, and direct staff to bring back a <br />recommendation for the credit system, and further research making the credit retroactive, <br />reviewing the application procedure, and the storm water management impact fee. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Anderson, and <br />Connolly. Voting No: None. Absent: CouncilmemberZimmerman. <br /> <br />Consensus of the Council was to have the Public Works Committee review the staff <br />recommendations prior to being brought back to Council. <br /> <br />Case #3: Adopt Ordinance to Amend Commercial Tower Regulations <br /> <br />Community Development Director Frolik stated that on October 24, 2000, the City Council <br />introduced an ordinance to amend the City's commercial tower regulations. Subsequent to <br />Council's introduction of the ordinance on October 24, 2000, City staff determined that some <br />minor text changes were necessary in the ordinance. Staff needed to clarify that ten acre parcel <br />sizes were not required for the placement of antennas on existing towers or structures, or for <br />parks adjacent to industrial or commercial uses. Ms. Frolik noted that the Planning Commission <br />has not reviewed the ordinance since the changes have been made. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Hendriksen, to table <br />adoption and send the item back to the Planning Commission for their review. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Hendriksen, and <br />Connolly. Voting No: None.
