City Attorney Goodrich replied no, and also noted that the City does have language in the <br />subdivision code and would address maintenance of landscaping. <br /> <br />Mayor Gamec stated that if there is landscaping between two developments and then a resident <br />removes the trees, there is nothing that the City can do about that. <br /> <br />City Attorney Goodrich replied that it would be possible for the City to Place an easement in that <br />section of the property. <br /> <br />Mayor Gamec stated then the City would own that piece of property and be required to maintain <br />it. <br /> <br />Mr. Gordon explained that landscaping would be an issue in multi-dwelling development and <br />would be maintained by an association. <br /> <br />Councilmember Anderson stated that she still had some reservations and she would like to see <br />some examples as to how the ordinance would truly work. She is concerned because it appears <br />as if the City will have a mixed use development in the near future and is concerned as to the <br />impact this ordinance would have on that development. <br /> <br />City Attorney Goodrich stated that it would be possible for the Council to introduce the <br />ordinance and then review the ordinance further at a work session. <br /> <br />Councilmember Hendriksen noted that if the development is occurring in a location where there <br />is not an existing neighborhood, then the ordinance is exempt. <br /> <br />Councilmember Anderson replied that she is not ready to move forward without further <br />researching the impacts of the ordinance. <br /> <br />Mayor Gamec inquired as to whether an ordinance has to be adopted in a certain amount of time <br />once it is introduced. <br /> <br />City Attorney Goodrich replied no. <br /> <br />Mayor Gamec stated that the ordinance was drafted to protect existing residents, but questioned <br />what would happen in the situation where the existing residents have been buffered by the new <br />development, then chose to connect to City sewer and water, and wanted to divide their lot. He <br />asked if they would have to comply with the same regulations. <br /> <br />Mr. Gordon replied that the idea of the ordinance was to address larger subdivisions and he was <br />not sure of the impact it would have on a lot split situation. <br /> <br />City Council/November 14, 2000 <br /> Page 13 'of 19 <br /> <br /> <br />
