Chairperson Nixt stated he would love to keep the business in Ramsey, but it has to <br />move somewhere else. <br /> <br />Commissioner Brauer indicated he could agree to 90 days if they had some assurance that these <br />violations will not continue to occur during that time. <br /> <br />Chairperson Nixt stated he would be willing to give Mr. Guzzo until March 31st, but that would <br />be the longest amount of time. <br /> <br />Motion by Commissioner Brauer, seconded by Chairperson Nixt, to recommend that the City <br />Council adopt Findings of Fact relating to Robert Guzzo's request for an interim use permit, with <br />the following clarifications: <br />29. That the proposed use will adversely impact traffic in the area. <br />30. That the proposed use will not be compatible with the residential neighborhood due to <br /> density and lot size of the surrounding lots. <br />31. That the proposed use will be unduly dangerous or otherwise detrimental to persons residing <br /> or working in the vicinity of the use or to the public welfare. <br />32. That the proposed use will substantially adversely impair the use, enjoyment, or market <br /> value of any surrounding property. <br />33. That the proposed use will be hazardous or disturbing to existing or future neighboring uses. <br />34. That the proposed use will not be served adequately by public facilities and services such as <br /> highways and streets. <br />35. That the proposed use will create excessive additional requirements at public cost for public <br /> facilities and services, and it will be detrimental to the economic welfare of the community. <br />36. That the proposed use will involve activities and uses that will be detrimental to any <br /> persons, property, or the general welfare by reason of excessive production of traffic, noise, <br /> smoke, fumes, glare, or odors. <br />37. That this is extension is granted to give the owner of the business adequate time to facilitate <br /> the transfer of his business to an appropriately zoned commercial facility. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Brauer, Levine, Shepherd, Van <br />Scoy, and Watson. Voting No: None. Absent: Commissioner Johnson. <br /> <br />Motion by Commissioner Brauer, seconded by Levine to recommend that the City Council <br />approve the request for an interim use permit based on the findings of fact, with the following <br />correction: <br />1. That this resolution shall allow for a sign business to operate within a detached accessory <br />building that is located on the Subject Property until March 31, 2006 while the owner facilitates <br />the transfer of his business to an appropriately zoned commercial facility. <br /> <br />Commissioner Van Scoy indicated that it sounds like there were several complaints made to the <br />City, and asked what actions resulted. <br /> <br />Planning Commission/December 1, 2005 <br /> Page 9 of 10 <br /> <br /> <br />
