REPORT AND RECOI~(ENDATION TO THE <br /> <br />STERN CO)~'MI1-TEE AND THE CITY COUNCIL <br /> <br />Following the City Council's meeting with the STERN Committee <br />on September 19, 1988, our Staff began research into proper <br />amendment to the City's zoning regulations that will respond <br />positively to the STERN Committee's stated concerns about <br />incinerators. We are now evaluating the performance standards <br />of other communities and finding that the air quality question <br />is not addressed as firmly as either the City Council or STERN <br />would like. Thus, we must look to standards which are measurable <br />and enforceable to use in our community. <br /> <br />Additionally, the timing requirement presents a problem in that <br />absentee ballots are needed by Friday of this week (10/7/88). <br />The procedure to amend a zoning ordinance 'takes a minimum of 84 <br />days and a more realistic expectation of t00 days. <br /> <br />Recognizing these factors we are recommending the following: <br /> <br />1) <br /> <br />The STERN Committee and the City Council agree to hold a special <br />election on the question posed by the STERN Committee I~F <br />satisfactory zoning amendments are not adopted within six <br />(6) months from this date. <br /> <br />2) <br /> <br />The City Council adopt a moratorium on any development which <br />wishes to install incinerators for six (6) months or until <br />the aforementioned zoning amendments are law. <br /> <br />Staff will research and prepare draft amendments to the zoning <br />regulations by ~ovember 15, 1988 and a hearing on the amendments <br />will be held by the Planning and Zoning Commission. <br /> <br />OTHERWISE <br /> <br />Staff will have the question posed by the STERN Committee <br />placed on the ballot immediately. <br /> <br /> <br />
