Further, that the following <br />amendments shall be made to the development agreement: <br /> <br />The second paragraph of the permit should be amended to indicate that <br />the permit is not perpectual, but rather valid for a period of 12 <br />months following issuance. <br /> <br />Item #11 of the permit should be amended to indicate that there will <br />he no hauling on residential streets; only State, County and MSA <br />streets constructed as 9 tons roads shall be used as haul routes; all <br />haul routes shall be subject to approval of the City or City Engineer. <br /> <br />Item #12 of the permit should be amended to indicate that no build up <br />of material shall be permitted on haul routes. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case ~10: Cond{t{onal u~e nerm{t amendment for Mr, Ro~er Hurd <br /> <br />Mr. Otto recalled that City Council approved a conditional use permit for <br />Mr. Hurd to have a used vehicle sales lot at the intersection of County <br />Road 56 and Highway 10. Mr. Otto stated that Mr. Nurd is currently in <br />violation of the conditional use permit in the following ways: <br /> <br /> i. The access from County Road 56 has not been relocated to within <br /> the boundaries of the proposed frontage road adjacent to the <br /> railroad tracks. <br /> <br />Dedication of easement for the proposed frontage road along the <br />railroad tracks has not been provided. <br /> <br />3. The exit onto Highway i0 has not been relocated to the Western <br /> boundary of the property. <br /> <br />4. An additional 27 feet of right-of-way along Ramsey Blvd. has not <br /> been dedicated to the County for future improvements to that <br /> road. <br /> <br />Mr. Otto also stated that Mr. Hurd cannot comply with those conditions of <br />the permit requiring dedication of easement because he is not the legal <br />owner of the property. Mr. Otto also noted that Mr. Hurd has paved his <br />vehicle sales lot to within the 27 feet of right-of-way to be dedicated to <br />the County.
