That the Applicant is request a variance for encroachment of <br /> approximately 10.5 feet to the front yard setback requirement. <br /> <br />Commissioner Holm stated that granting a variance to mistakes is setting a <br />precedent. <br /> <br />Commissioner LaDue noted that the mistake is both on the part of the <br />Applicant and the City. <br /> <br />Commissioner Hendriksen noted that variances for errors have been granted <br />in the past. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Hendriksen to <br />amend Item 910 of the proposed findings of fact as follows: <br /> <br />10. That the special conditions and circumstances result from the <br /> combined actions of the Applicant and the City of Kamsey. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Hendriksen, <br />LaDue, Holm and Terry. Voting Ho: None. Absent: Commissioners Howell <br />and Zimmerman. <br /> <br />Motion by Commissioner Terry and seconded by Commissioner Holm that Item ~9 <br />of the proposed findings of fact read as follows: <br /> <br />9. That the granting of such a variance is necessary to the <br /> preservation of substantial property rights. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Hendriksen, <br />LaDue, Holm and Terry. Voting No: None. Absent: Commissioners Zimmerman <br />and Howell. <br /> <br />Motion by Commissioner Terry and seconded by Commissioner Eendriksen to <br />adopt Findings of Fact 0220 relating to Mr. Paul Bertils' request for a <br />variance to front yard setback requirements. (Refer to findings of fac: <br />file for Findings of Fact 0220). <br /> <br />Motion carried. Voting ~es: Chairman Shumway, Commissioners Hendriksen, <br />LaDue, Holm and Terry. Voting No: None.
