10. <br /> <br />standards shall be used as haul roads. <br /> <br />No build up of material shall be permitted and in the event that <br />build up does occur, the property owner shall be responsible for <br />any costs incurred in removal of same. <br /> <br />11. Dust created by travel on the access road shall be controlled by <br /> appropriate means by the property owner. If it is not possible to <br /> control the dust on any given day, the extraction operation shall <br /> cease on that day. If, in the opinion of the City Engineer, the <br /> dust created by the operation is excessive, the operation shall <br /> cease until the dust problem is abated. <br /> <br />12. In order to prevent excessive dust pollution, the excavation <br /> operation shall discontinue at any time when wind gusts are in <br /> excess of 30 miles per hour. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />A performance bond in the amount of $7,500.00 per five acres of <br />property to be excvated shall be filed with the City to cover any <br />screening, buffer and turf establishment costs incurred in the <br />restoration plan. This bond shall be kept current until the <br />grading and excavation operation in finally completed. <br /> <br />The property owner shall be responsible for all expenses incurred <br />in the administration of this conditional use permit. <br /> <br />Mr. Schulte shall provide to the City a liability insurance <br />policy or certificate of such insurance acceptable to the City and <br />issued by an insurance company authorized to do business in the <br />State of Minnesota. <br /> <br />The policy shall insure the person performing acts described <br />herein for the sum of at least three hundred thousand dollars <br />for injury to one person, and five hundred thousand dollars <br />for one accident and at least one hundred thousand dollars <br />for property damage. <br /> <br />be <br /> <br />Said policy shall be for the full period of the permit and <br />shall provide for the giving of ten days prior notice to the <br />City Administrator by registered mail or termination, <br />cancellation, or amendment of the policy. <br /> <br />Oe <br /> <br />In the event said policy is terminated for any reason, the <br />permit shall be automatically suspended upon the day the <br />policy terminates, unless a new policy complying with this <br />section is obtained and filed with the City Administrator <br />prior to the termination of the policy in force. <br /> <br />Weeds and other unsightly or noxious vegetation shall be cut or <br />trimmed as may be necessary to preserve a reasonably neat <br />appearance of the site and to minimize seeding on adjacent <br />property. <br /> <br />Ail hauling operations shall be completed so as to minimize <br />noise, safety and dust concerns to adjacent residential <br />properties. <br /> <br /> <br />
