Chairman Shumway called the regular meeting back to order at 7:37 p.m. <br />APPROVAL OF BOARD OF ADJUSTMENT MEETING MINUTE~ <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner LaDue to <br />approve the following minutes: <br /> <br />1. Board of djustment public hearing minutes dated August 30, 1988 <br /> A ' <br /> regarding Mr. Lynn Boehland's request for a variance to construct an <br /> in-ground swimming pool nearer the front lot line than the principal <br /> structure. <br /> <br />2. Board of Adjustment regular meeting minutes dated August 30, 1988. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Hendriksen, <br />LaDue, Holm and Terry. Voting No: None. Absent: Commissioners Howell <br />and Zimmerman. <br /> <br />BOARD OF ADJUSTMENT BUSINESS <br /> <br />Case <br /> <br />Reauest For Variance From Sect{on 170.076 Of The Rmmsev <br /> Code To Encroach On The Trott Brook Setback: Case Of Mr. <br /> SorteberE: <br /> <br /> Mr. James Sorteberg was present requesting a variance to the Trott Brook <br /> setback in order to add a 3-season porch to his home. <br /> <br /> Ms. Frolik noted that she had talked to John Stine of the DNR on September <br /> 22, 1988 and he indicated that Mr. Sorteberg's property is in the flood <br /> zone and may be subject to Flood Plain Management restrictions. Mr. Stine <br /> recommended that the Board table any action and require Mr. Sorteberg to <br /> have ground elevations taken at the house location and at the lowest floor <br /> elevation of the home to determine whether those Flood Plain Management <br /> restrictions will apply to Mr. Sorteberg's proposed addition to his home. <br /> <br /> Building Official Erickson explained that if the Flood Plain restrictions <br /> do apply, one of the major requirements is that the structure be <br /> constructed one foot above the flood plain elevation. Mr. Erickson <br /> suggested that a variance be granted contingent upon Mr. Sorteberg <br /> providing the elevation measurements to the Building Official. <br /> <br />Mr. Sorteberg stated that he talked to Mr. Stine before he applied for the <br />variance and Mr. Stine had indicated that he did not foresee any problems. <br />Mr. Sorteberg also questioned how the home on the property could have been <br />issued a building permit if it is in the flood plain. <br /> <br />Chairman Shumway noted that this is not the first instance of an <br />applicant's version of Mr. Stine's comments differing from that of City <br />Staff. Chairman Shumway directed City Staff to contact Mr. Stine to <br />determine why there is a discrepancy in City Staff versus 'applicant' <br />understanding of his directives. <br /> <br />Commissioner Terry suggested that the variance be granted contingent upon <br />the structure meeting requirements of the Ramsey City Building Code and if <br /> Board of Adjustment/September 22, 1988 <br /> <br />Page 2 of 6 <br /> <br /> <br />
