That Mr. John Stine of the DNR has indicated that the subject <br /> property is also in the Flood Plain Management District. <br />Further Discussion: Commissioner Hendriksen noted that Mr. Stine has also <br />recommended that the case be tabled. Commissioner Holm stated that his <br />motion stands as proposed. <br /> <br /> Motion carried. Voting Yes: Chairman Shumway, Commissioners LaDue, Holm <br /> and Terry. Voting No: Commissioner Nendriksen. Absent: Commissioners <br /> Zimmerman and Howell. <br /> <br /> Motion by Commissioner LaDue and seconded by Commissioner Terry to adopt <br /> Findings of Fact 0219 relating to Mr. James Sorteberg's request for a <br /> variance. Absent: Commissioners Howell <br /> and Zimmerman. <br /> <br /> Motion by Commissioner Holm and seconded by Commissioner LaDue directing <br /> that Item #1 of the variance should indicate that the porch structure shall <br /> not encroach on the Trott Brook setback by more than 30 feet. <br /> Motion carried. Voting Yes: Chairman Shumway, Commissioners Hendriksen, <br /> LaDue, Holm and Terry. Voting No: None. Absent: Commissioners Howell <br /> and Zimmerman. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Holm to approve <br />Mr. Sorteberg's request for a variance with Item ~1 as amended and Item #2 <br />amended as follows: <br /> <br />No construction of the structure shall commence prior to the <br />issuance, by the Building Official, of a building permit and <br />certification of the variance by DNR; further, that the lowest <br />floor elevation shall be one foot above flood plain. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Hendriksen, <br />LaDue, Holm and Howell. Voting No: None.
