undetected by the Building Department during the footing inspection. <br /> <br />Mr. Bertils presented a certified survey of the lot since the installation <br />of the basement and it indicated that a 10.5 variance to front yard setback <br />will be necessary. <br /> <br />The Board proceeded to review the proposed findings of fact and amended <br />Item #7 as follows: <br /> <br />7. That the Applicant is request a variance for encroachment of <br /> approximately 10.5 feet to the front yard setback requirement, <br /> <br />Commissioner Holm stated that granting a variance to mistakes is setting a <br />precedent. <br /> <br />Commissioner LaDue noted that the mistake is both on the part of the <br />Applicant and the City. <br /> <br />Commissioner Hendriksen noted that variances for errors have been granted <br />in the past. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Hendriksen to <br />amend Item #10 of the proposed findings of fact as follows: <br /> <br />10. That the special conditions and circumstances result from the <br /> combined actions of the Applicant and the City of Ramsey. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Hendriksen, <br />LaDue, Holm and Terry. Voting No: None. Absent: Commissioners Howell <br />and Zimmerman. <br /> <br />Motion by Commissioner Terry and seconded by Commissioner Holm that Item #9 <br />of the proposed findings of fact read as follows: <br /> <br />9. That the granting of such a variance is necessary to the <br /> preservation of substantial property rights. <br /> <br />Motion carried. Voting Yes: Chairman 8humway, Commissioners Hendriksen, <br />LaDue, Holm and Terry. Voting No: None. Absent: Commissioners Zimmerman <br />and Howell. <br /> <br />Motion by Commissioner Terry and seconded by Commissioner Hendriksen to <br />adopt Findings of Fact 0220 relating to Mr. Paul Bertils' request for a <br />variance to front yard setback requirements. (Refer to findings of fact <br />file for Findings of Fact 0220). <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Hendriksen, <br />LaDue, Holm and Terry. Voting No: None. Absent: Commissioners Howell <br />and Zimmerman. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Hendriksen to <br />approve Mr. Paul Bertils' request for a variance with Item #i amended to <br />read as follows: <br /> <br />Board of Adjustment/September 22, 1988 <br /> <br />Page 4 of 6 <br /> <br /> <br />
