Permit Period. This permit shall be effective only from and after the date on which the bond and insurance coverages required to be provided hereunder have been transmitted to, reviewed and accepted by the city. Thereafter, the permit shall be in force and effect until three (3) years issuance, unless sooner revoked. Application for annual review shall be made by April 30 each year. Required insurance and appropriate bond shall be submitted to the City by June 15 of the renewal license year. Term. Neither this permit nor any renewal thereof shall authorize or permit the conduct of active landfill operations on the landfill site after January 1, 1991 by which date all active landfill operations will cease. For purposes of this paragraph, "active landfill operations" shall mean the placing of any refuse, trash, debris, garbage, waste or any other such similar materials on the Landfill Site. Riaht to Require Performance. The failure of the city at any time to require performance by WI~MI of any provisions hereof shall in no way effect the right of the city thereafter to enforce the same. Nor shall waiver by the city of any breach of any of the provisions hereof be taken or held to be a waiver of any succeeding breach of such provision or as a waiver of any provision itself. Severabi!itv. If any provision of this Conditional Use Pe-~mit shall be declared'void or unenforceable, the other provisions shall not be a.~e~ed, but shall remain in full force and effect. Modification. This Conditional Use Permit constitutes the entire agreement and understanding between the parties hereto, and it shall no~ be considered modified altered, changed or amended in any respect unless in writing and signed by the parties hereto. v_o_a._on of Modification, Suspension or Revocation of Permit.
