Violation of Conditions. If W/fMI or its successors or assigns violates any term or condition imposed by this Conditional Use Permit, it may be revoked and terminated. Without limiting the foregoing, the violation of any statute, regulation, ordinance or permit condition imposed by lawful governmental authority and governing operations on the landfill site is grounds for revocation and termination of this Conditional Use Pea--mit. The change, alteration or amendment of any such statute, regulation, ordinance or permit condition by any governmental authority other than the City shall not excuse WFLMI from compliance with statutes, regulations ordinances or permit conditions in effect on the date of the original issuance of this permit unless compliance is waived or excused by the City. Violation a Misdemeanor. Violation of any of the provisions of this Conditional Use Permit is declared to be a violation of the City of Ramsey in accordance with Section of the Zoning Ordinance. Closure Due to Pernit Revocationr Other Circumstances. In the event this permit is revoked or WMi~I closes operation of the landfill for any reason, including but without limitation, order of the court or other agency of competent jurisdiction, bankruptcy, insolvency, or abandonment, ~CM.I shall immediately proceed to close, cover and grade the Landfill Site according to the closure plan approved by the City and which shall comply with all requirements of the MPCA and Anoka County relating to final closure. In'the event the W.nflMI fails to comply with the terms of this permit, the City may, upon 90 days prior notice to ~q~[I enter into the property and perform all such obligations, the costs of which shall be borne by ~q_~M.I or, in default thereof, by its surety. Nonassiqnability of Pe.--mit. Any rights conferred on h.n~:i by this Permit are personal to the Pe_~it Holder. The City is issuing this Permit on the basis of the credit and reputation of W%5[i. ~LM_.i shall not assign or transfer this permit without first obtaining approval of the city which may allow cr disallow such transfer in its absolute and sole discretion, in the event the City declines for any reason to allow the transfer of this Permit, ~.~Y2f_.i shall either continue landfill operations in full comp!lance with the te-~s of this Pert. it cr te_--r, inate landfill operations. Annual Review. This permit and the perfc~ance cf the owner/operator shall be reviewed annually by the City Council at least 50 days prior to the anniversary date cf the pe_--~.it date.
