insurance to the extent and for such period of time as herein speci- fied under 3.3. 3.2. Reimbursement to city: In the event the COUNTY refuses or fails to perform its obligations hereunder and such default is recog- nized by judgment, order or declaratory judgment by a court of compe- tent jurisdiction in an action brought by the CITY against the COUNTY, the CITY shall be entitled to recover all costs, disbursements and fees associated with such action from the COUNTY, including any actual reasonable attorney's fees and expert witness fees. 3.3. Te.--m: The term of this agreement shall be fifty (50) years from the date of final closure of the Landfill. 3.4.
