17. Location of Landfill Cellsr Percolation Pond and Stockpiled <br /> Materials. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />22. <br /> <br />23. <br /> <br />a) <br /> <br />Landfill cells, the percolation pond and stockpiled materials <br />shall not be located within 66' from the south property line. <br /> <br />b) <br /> <br />The percolation pond shall be situated on the east half of the <br />site such that it is situated outside of the planned 66' <br />frontage road right-of-way and the existing and planned Runway <br />34 clear zones. <br /> <br />c) <br /> <br />d) <br /> <br />Stockpiling of concrete waste products shall not occur on the <br />landfill parcel. <br /> <br />Cover material and topsoil material shall be stockpiled on the <br />east half of the site. <br /> <br />e) <br /> <br />Landfill cells shall be developed in a logical sequence and <br />the location shall be subject to approval by the City <br />Engineer. The preferred sequence is to fill within the runway <br />clear zone.first working from north to south. <br /> <br />All activities including but not limited to grading, stockpiling <br />of materials, landfill operations and storage activities shall <br />comply with FAR Part 77 regulations in the existing and planned <br />clear zones and said activities are coordinated with the airport <br />manager at Gateway Industrial North Airport. <br /> <br />Landfill disposal of waste materials shall occur during a single <br />time period each year. The permit holder shall notify the City at <br />least !0 days in advance of the period he will be landfilling. <br /> <br />The permit holder acknowledges that the city has granted a condi- <br />tional use permit solely for the convenience of the pe.'-mit holder. <br />The permit holder further agrees that said pe-~mit shall be given <br />no value in any subsequent negotiations in the event of land <br />acquisition by the City. <br /> <br />Right to Require Perfo-~aance. The failure cf the City, at any <br />~ime, to re~.~uire perfor~ance by the Pe~'mit Holder of any provi- <br />sions hereof shall in no way effect the right of the city there- <br />after to enforce the same. Nor shall waiver by the City of any <br />breach of any of the provisions hereof be taken or held to be a <br />waiver of any succeeding breach of such provision or as a waiver <br />of any provision itself. <br /> <br />Severability. if any provision of this Conditional Use Pe.--mit <br />shall be declared void or unenforceable, the other provisions <br />shall not bea..e~e~,~ -~ ~ b~."~ shall remain in full force and effect. <br /> <br />Modification. This Conditional Use Pe_~it constitutes the entire <br />agreement and understanding between the parties hereto, and it <br />shall not be considered modified altered, changed or amended in <br />any respect unless in writing and signe~ by the par~ies hereto. <br /> <br />4 <br /> <br /> <br />
