the City Council wants to do something about stopping this type of development they <br />need to do something about the ordinance. <br /> <br />Mr. Elvig agreed, stating that is why he wants to puli it back, and he will be lobbying to <br />do so. <br /> <br />Commissioner Van Scoy asked if Mr. Elvig is here as a citizen or a member of the City <br />Council. <br /> <br />Mr. Elvig stated he is here as a City Council Member, but as a single member, and he <br />does not express the feelings of all of the City Council. <br /> <br />James Daniels, 5235 177th Avenue, asked why as a property owner he was not noticed. <br />He indicated that if it was not for a neighbor coming around with a petition he would not <br />have known. He asked why they put a light on Erkium that he paid for. <br /> <br />City Engineer Jankowski indicated that this year they will be completing the remaining <br />priority light program~ <br /> <br />Ms. Wald indicated that as a developer they can appreciate the City's concerns, since this <br />is a new ordinance, and this development is the first one through. She noted, however, <br />that they were proposing a development that is allowed by City Code. She stated they are <br />not proposing townhomes, and they are not proposing anything that is against the <br />ordinance. She indicated they will continue to work with Staff. <br /> <br />Motion by Vice Chairperson Johnson, seconded by Commissioner Van Scoy to continue <br />the public hearing and request for preliminary plat of Shade Tree Creek to the March <br />Planning Commission meeting, and ask that the City Council speak to this matter before <br />that meeting. <br /> <br />Commissioner Brauer stated they have been talking about needing better communication <br />with the City Council. He indicated that given the mass of this issue it might be a good <br />time for a work session with the Planning Commission. and City Council. He stated he <br />does not know if they have time in this case, but it may be beneficial. <br /> <br />Vice Chairperson Johnson asked if there were time constraints. <br /> <br />Assistant Community Development Director Frolik stated they are tracking it, but the <br />City can impose one 60-day extension. <br /> <br />Commissioner Van Scoy indicated there are an awful lot of citizens in the City that are <br />surprised this ordinance even exists. He stated this has been a major policy change, and <br />there has to be a better way to communicate these changes. He indicated that he realizes <br />they followed all of the standard procedures, but this bothers a lot of people, as it does the <br />Planning Commission and City Council. He stated that as they continue with this, the <br />City needs to keep working on improving communication. <br /> <br />34 <br /> <br /> <br />
