CASE <br /> <br /> PUBLIC HEARING <br /> REQUEST FOR A CONDITIONAL USE PERMIT FOR A <br /> MONOPOLE COMMUNICATIONS TOWER; <br /> CASE OF CINGULAR WIRELESS, INC <br />By: Patrick Trudgeon, AICP, Community Developme. nt Director <br /> <br />Background: <br /> <br />The City has received an application from Cingular Wireless to construct and operate a <br />monopole communication tower, intended to fill a gap in Cingular's wireless phone network. <br />The proposed tower will be located at 6405 Green Valley Road on property owned by Jeffrey and <br />Caroline Rowe. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Tower Overlay District Map <br />Site Plan showing location of tower on property. <br />Tower Details <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sent out notices to all property owners within 350 feet. <br /> <br />Observations: <br /> <br />Towers are permitted in residential districts as long as they axe located in the Tower Overlay <br />District (s6e attached map) and are at least I0 acres in size. The subject property is located <br />within the Tower Overlay District but does not meet the minimum lot size of 10 acres. The <br />subject property, Lot 4, Block I, Valley View Estates is approximately 9.27 acres in size. The <br />minimum lot size in the area is 10 acres. As part of the Valley View Estates plat approved in <br />2000, four lots were created, all less than 10 acres. The original parcel was 38.7 acres and under <br />City Ordinances were allowed to create 4 lots. The developer received a variance for Lots 1-3 for <br />lot size and lot width. Lot 4 (the subject property), was allowed to be created as a remnant parcel <br />per City Ordinances. It should be noted that when Lot 4 was created, the County requested an <br />additional 27 feet of right,of-way to be dedicated for Green Valley Rd. (CR 63). If the right-of- <br />way is included, Lot 4 is approximately 10.3 acres. <br /> <br />Since Lot 4 is Iess than I 0 acres, the lot technically cannot have a communications tower located <br />upon it unless a variance is granted. Staff is of the opinion that the applicant must receive a <br />variance to minimum lot size prior to consideration of the conditional use permit request to <br />construct a communications tower on the Rowe property. <br /> <br />43 <br /> <br /> <br />
