Board Member XXXXXX introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #0 6-Y~X-2CX. XX <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CUL-DE-SAC <br />LENGTH IN THE PROPOSED PLAT OF SHADE TREE CREEK ANI) DECLARIaNG <br />TERMS OF THE SAME. <br /> <br /> WltEREAS, Shade Tree Construction (Permittee) has properly applied for a variance <br />from the maximum cul-de-sac length prescribed in Section 9.50.30, Subd. 4(g) on the property <br />genemlly located south of 173'a Avenue and southeast of Puma Street and legally described as <br />follows: <br /> <br />The Northwest Quarter of the Southwest Quarter of Section 1, Township 32, Range 25, <br />Anoka County, Minnesota. <br />Subject to an easement for road purposes over the west 66.00 feet of the east 250.81 <br />feet thereof. <br /> <br /> WHEREAS, the Board of Adjustment met on February 2, 2006, conducted the public <br />hearing and tabled the application relating to the request for a variance from the maximum cul- <br />de-sac length requirements on the Subject Property and, <br /> <br /> WHEREAS, the Board of Adjustment met on March 3, 2006, continued the public <br />hearing and approved the application relating to the request for a variance from the maximum oil- <br />de-sac length requirements on the Subject Property. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #XXXX, a variance to the 600-foot cul-de-sac length, as <br />established in Section 9.50.30, Subd. 4(g) of the Ramsey City Code, is hereby granted for <br />the Subject Property for Erkium and 177~h Avenue. <br /> <br />The variance allows for a temporary cul-de-sac to be constructed to a maximum length of <br />1,300 feet. <br /> <br />The Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Chairperson <br />XXXX, and upon vote being taken thereon, the following voted in favor thereofi <br /> <br />and the following voted against the same: <br /> <br /> <br />
