Board Member XXXXXX introduced the following resolution and moved for its adoption: RESOLUTION #0 6-Y~X-2CX. XX A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CUL-DE-SAC LENGTH IN THE PROPOSED PLAT OF SHADE TREE CREEK ANI) DECLARIaNG TERMS OF THE SAME. WltEREAS, Shade Tree Construction (Permittee) has properly applied for a variance from the maximum cul-de-sac length prescribed in Section 9.50.30, Subd. 4(g) on the property genemlly located south of 173'a Avenue and southeast of Puma Street and legally described as follows: The Northwest Quarter of the Southwest Quarter of Section 1, Township 32, Range 25, Anoka County, Minnesota. Subject to an easement for road purposes over the west 66.00 feet of the east 250.81 feet thereof. WHEREAS, the Board of Adjustment met on February 2, 2006, conducted the public hearing and tabled the application relating to the request for a variance from the maximum cul- de-sac length requirements on the Subject Property and, WHEREAS, the Board of Adjustment met on March 3, 2006, continued the public hearing and approved the application relating to the request for a variance from the maximum oil- de-sac length requirements on the Subject Property. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact #XXXX, a variance to the 600-foot cul-de-sac length, as established in Section 9.50.30, Subd. 4(g) of the Ramsey City Code, is hereby granted for the Subject Property for Erkium and 177~h Avenue. The variance allows for a temporary cul-de-sac to be constructed to a maximum length of 1,300 feet. The Permittee shall be responsible for all City costs incurred in administering and enforcing this variance. The motion for the adoption of the foregoing resolution was duly seconded by Chairperson XXXX, and upon vote being taken thereon, the following voted in favor thereofi and the following voted against the same:
