13. 14. I5. Payment for Stage II Improvements. The CITY will install in the Plat the Stage II Improvements. The DEVELOPER shall also deposit an amount that is determined by the CITY to be adequate to aid in the operation and maintenance of street lights in locations within the Plat determined by the City Engineer and installed by Connexus for the first throe (3) years after final plat approval. The CITY will bill residents in the Plat at least quarterly for street light maintenance and operation costs; billing will be initiated at the time a residence connects to municipal water and sanitary sewer. The DEVELOPER will pay to the CITY an amount equal to 100% of the City Engineer's estimated construction cost of the items prior to recording of the final Plat. The City Engineer's estimated cost of construction is: a) Street striping (4,030 feet ~ $.20) b) Street Signing (5 ~ $200.00) c) Traffic signing (3 ~ $200.00) d) Street lights (12 ~$1,500.00) e) Street light maintenance (12 ~$270.00) f) Street sweeping g) Sealcoating (14,330 sq. yds ~$.85/sq. yd.) $806.00 $1,000.00 $600.00 $18,000.00 $3,240.00 $500.00 $12,180.00 ("Stage II Improvements") Total $36,326.50 Hard Surfaced Driveways. Hard surfaced driveways (bituminous or concrete) are a requirement for each lot in the Plat. Said improvement shall be installed by the building permit applicant or the homeowner at the time the Certificate of Occupancy is issued or as soon thereafter as possible, weather permitting. In the event this improvement is not timely installed on a lot, the DEVELOPER and/or the DEVELOPER'S assign(s), agrees that the CITY may install said improvement on the lot and specially assess the cost therefore against the lot. The DEVELOPER hereby waives all right to a public hearing and other statutory rights or City Charter fights granted a property owner relating to special assessments, including the right to appeal the special assessment for installation of the hard surfaced driveway. In addition, the DEVELOPER grants the CITY a license to enter on each lot of the Plat in order to install the improvement described in this paragraph if the same has not been previously constructed. Street Cleaning. After the street surfacing is installed, the DEVELOPER shall clear any soil, earth, or debris from the streets within the Plat resulting from any construction within the Plat by the DEVELOPER or its successors and assigns. From time to time, the CITY may remove accumulations of soil, earth and debris from the streets resulting from the construction of the Plat. It shall be the DEVELOPER'S responsibility to pay the costs associated with this necessary street cleaning. Invoices from the CITY to the DEVELOPER for such costs shall be paid within fifteen (15) days of the date of invoice. -160- MeadowSabdivBion DevelopmentAgreement Page 6of12
