SECTION III <br />PERMITS AND OCCUPANCY <br /> <br />16. Requirements for Building and Occupancy Permits. No building permit for any lot in the <br /> Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the <br /> structure; (b) a Certificate of Survey, including that survey information required by the <br /> CITY has been supplied to the City Building Official; (c) all the f'mancial guarantees <br /> required by the CITY have been satisfied; and (d) this Development Agreement has been <br /> signed and received by the CITY. All foundation approvals will require a certificate of <br /> elevation verifying that the actual elevation is in compliance with the approved grading and <br /> drainage plan. <br /> <br />Lot 1, Block 2 shall not be eligible for a building permit until such time as the temporary <br />easement for ingress/egress and drainage and utility has expired. Said temporary easement is <br />proposed to remain in effect until Krypton Terrace N.W. is extended to intersect with <br />Nowthen Blvd. and the temporary access to Nowthen Blvd. across Lot I, Block 2 is <br />eliminated. <br /> <br />No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to the <br />lot is provided including the installation of at least one layer of bituminous surfacing; (b) all <br />utilities are in place, operational and accepted by the CITY; (c) for lots that have a slope of <br />less than 2%, a certificate of grading, prepared by a licensed (State of Minnesota), <br />professional land surveyor, must be provided to the City documenting that the flattest grade <br />on this lot is 1% or greater will require certificates of grading; and (d) boulevard sod and <br />landscape tree, or escrow for same, have been provided. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />17. Cash Contribution. The Meadow Plat is located in the Prairie Recreation District. Park <br /> dedication requirements shall be satisfied by a cash payment. The Plat is creating forth-six <br /> (46) new residential lots, .which equates to a cash payment of One Hundred Ten Thousand <br /> Four Hundred Ten Dollars and no cents ($110,400.00) (46 lots x $2,400/lo0. The Plat is also <br /> creating a new commercial lot for which the park dedication due is Ten Thousand Five <br /> Hundred Eighty Dollars and no cents ($10,580.00) ($4,600 x 2.3 acres). The three (3) <br /> existing homesteads (Lots 1-3, Block 1) and the existing dental clinic (Lot 7, Block 2) are <br /> exempt from the Park Dedication Fee. This payment shall be made to the City prior to the <br /> release of the Final Plat for recording. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />18. Trail Development Fees.
