Chairman Peterson asked Ms. Cornelius how many cars she would estimate <br />she could get in her driveway at one time. <br />Ms. Cornelius estimated that she could get four or five cars in her <br />driveway at one time. <br />Ben•Deemer asked if this is one of the areas that will be blacktopped soon. <br />City Administrator Schnelle said that this was not one of the areas to <br />be blacktopped soon. <br />Gerald Zimmerman said one of the big problems is the road there and <br />the business would creat more traffic. <br />Ms. Cornelius said customers would only be passing three houses to get to <br />hers. <br />Ben Deemer asked Ms. Cornelius how she intended to heat the garage. <br />Ms. Cornelius said the garage is attached to the house and they intended <br />to heat it the same way they do their house with gas. She was informed that this <br />is against the City Code. <br />Ms. Cornelius asked if they could use electric heat. <br />Art Dunn said there was a distinction between this retail sales type of <br />occupation and a. Home Occupation -type business. <br />Ben Deemer said in a beauty shop business, there are only one or two <br />at the most there at a time and it is scheduled by appointment only. <br />Chairman Peterson said there are no other business of this type that he <br />know of in homes in the city at the present time. <br />Motion by Ben Deemer and seconded by Gerald Zimmerman to recommend <br />the City Council deny the request for a Conditional Use Permit to <br />operate a gift shop in the attached garage at the resident of Edith Cornelius <br />at 15231 Jaspar St. N.W. in view of the city's definition of Conditional <br />Use Permit under 170.061A for home occupations. <br />Motion carried 4-1. Art Dunn opposed the motion because the objections <br />were not clearly stated. <br />Ben Deemer said his reason for objecting was because this is a full - fledged <br />retail operation and in no way applies as a home occupation. <br />The commission went over the "Standards for Consideration" (170.061D). <br />a) The nature of the land upon which the use is to be located; - <br />no comment <br />b) The nature of the adjoining land or buildings; - It is in a residential <br />area. <br />c) The proximity of similar use; - There is a beauty shop in the <br />neighborhood, which is a home occupation. <br />P & Z Regular Meeting Page 3 10/3/80 <br />
