d) The effect upon traffic into and from the premises, or on any <br />adjoining roads; - There is a quarter mile of dirt road from <br />the nearest arterial. <br />e) The total number of similar uses within the city; - The commission <br />is not qualified to answer this as it would be up to the finding of <br />facts committee. <br />f) Whether or not the use will be dangerous or otherwise detrimental to <br />persons residing or working in the vicinity of the use, or to the <br />public welfare, or whether or not it will substantially impair the <br />use, enjoyment or value of any property; - It is detrimental to <br />property values. <br />Then the commission went over the "Criteria for Approval" (170.016E) <br />It was determined that it did not meet the criteria for approval because: <br />a) Public safety would be endangered with increased traffic on the <br />road. <br />• b) It would be injurious to the permitted uses and it would impair <br />property values within the area. <br />c) It would impede the orderly and normal development and improvement <br />of the surrounding property for uses permitted in the zoning <br />district because it is a B -1 use in a R -1 zoning area. <br />d) A turnaround would have to be built. <br />e) That the use does not conform to all applicable regulations of <br />the district wherein proposed because it is a B -1 use in an R -1 <br />zone. <br />Ms. Cornelius said she wanted this business so she could stay home with <br />her family. She said it is not to make big money or to have a big business. <br />She said she intended to keep it a small -type business for the people close <br />by. <br />Ben Deemer said he objected because of the increased traffic it would <br />bring to the neighborhood and he would not want to live next door to <br />a business of this type. <br />Art Dunn pointed out the many non - conforming uses in the city. <br />Harry Ellis said the commission can only recommend on those coming into <br />them in line with city ordinances and the commission doesn't have the <br />privilege of going out and stopping the non - conforming uses that are <br />presently going on. <br />Ben Deemer said if there is a complaint that is brought up by a citizen, <br />then the city can act on these problems. <br />Harry Ellis said this is felt to be a retail sales operation in an R -1 <br />district and a beauty shop is a home - occupation business. <br />P & Z Regular Meeting Page 3 10/3/80 <br />
