Chairperson Elvig expressed concem with the City proceeding with a remedy due to <br />possible liability in the future. <br /> <br />City Engineer Jankowski explained apparently when this floodplain map was created in <br />the late 1970s there was a negotiation between the City and FEMA about the various <br />reaches of the floodplain. It was determined that the City could build into the model up <br />to a ½ foot increase into the floodplain elevation by allowing some filling in the <br />floodplain. <br /> <br />Councilmember Cook stated the City should make an attempt to improve the situation <br />and Polaris should be able to handle this. <br /> <br />Motion by Councilmember Cook, seconded by Chairperson Elvig, to recommend to City <br />Council that it accept the proposal from the Polaris Group to provide services necessary <br />to resolve this possible floodplain violation issue with funding for this work to be from <br />the Storm Water Utility in an amount not to exceed $2,200. <br /> <br />Further discussion: Chairperson Elvig suggested the timing on this be looked into due to <br />the building permit being issued the same day the footings were inspected. He stated his <br />biggest concern is the City becoming responsible after becoming involved in mitigations. <br />Assistant Public Works Director Olson advised that FEMA has indicated they may pull <br />the City's floodplain eligibility. <br /> <br />Motion carded. Voting Yes: Chairperson Elvig and Councilmember Cook. Voting No: <br />None. Absent: Coun¢ilmember Olson. <br /> <br />Case #5: Receive Petition for Extension of Sewer and Water Service <br /> <br />Assistant Public Works Director Olson indicated staff received a petition for the <br />extension of sewer and water on July 8, 2005. The next step would be to prepare a <br />feasibility study outlining the costs, proposed assessments, schedule etc. Once the <br />feasibility study is prepared there would need to be a public heating scheduled to <br />determine if there is indeed support for the project. He advised staff recommends a <br />motion receiving the attached petition and, after City Attorney review as to form and <br />content of the petition, order preparation of the feasibility study considering the extension <br />of urban services to those petitioning. <br /> <br />Motion by Chairperson Elvig, seconded by Councilmember Cook, to recommend to the City <br />Council that the attached petition be received and, after City Attorney review as to form and <br />content of the petition, order preparation of the feasibility study considering the extension of <br />urban services to those petitioning properties. <br /> <br />Motion carried.
