Council Business <br /> <br />Mayor Gamec called the regular City Council meeting back to order at 7:29 p.m. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Olson, to adopt Resolution #06- <br />02-042 calling for a public hearing on proposed assessment for Improvement Project #02-40, and <br />to adopt Resolution #06-02-042A declaring cost to be assessed and ordering preparation of <br />proposed assessment for Improvement Project #02-40. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Olson, Elvig, Jeffrey, and <br />Pearson. Voting No: None. Absent: Councilmember Strommen. <br /> <br />Case #3: Reject Petition from Pondvale Residents <br /> <br />Assistant Public Works Director Olson reviewed that the City received a petition from Pondvale <br />Residents for a feasibility study for a water and sewer project on a portion of 150th Lane and <br />Helium Street. The petition was brought to the January 24, 2006 City Council meeting. Council <br />directed staff to contact each of the residents with the message that the residems would be <br />responsible for the cost of the feasibility study update if the project is not constructed. Mr. Olson <br />indicated staff contacted each of the residents and discovered that there was one original <br />signature on the petition; the remainder was added based on phone conversations between the <br />residents. The City Attorney reviewed this information and indicated that this is not a valid <br />petition. Staffrecommends rejection of the petition for a water and sewer project in Pondvale on <br />a portion of 150th Lane and Helium Street. <br /> <br />Motion by Councilmember Olson, seconded by Councilmember Elvig, to reject petition for a <br />water and sewer project in Pondvale on a portion of 150th Lane and Helium Street. <br /> <br />Motion carried. Absent: Councilmember Strommen. <br /> <br />Case #4: <br /> <br />Consider Watermain and Sanitary Sewer Cost Contribution Agreement with <br />Oakwood Land Development, Inc. for the City's Northwest and Northeast <br />Service Areas <br /> <br />Assistant Public Works Director Olson reviewed that plans and specifications have been drawn <br />to extend municipal water to the City's Northwest and Northeast Service Areas and municipal <br />sewer to the Northwest Service Area. Easement acquisition is underway and advertisement for <br />bids is in process. As a part of the project, Oakwood Land Development, Inc. has offered to <br />provide $6,000,000.00 toward the project's construction costs in consideration for the City <br />commencing the project to serve certain developments in the project area. Oakwood requires <br />that its $6,000,000.00 be reimbursed to it through credits for water and sewer hookup fees on lots <br />it develops as well as any other lots developed in the project area by other developers. He stated <br />issues with the proposed cost contribution agreement have been resolved with Oakwood Land <br />Development, Inc.
