It doesn't <br />seem to belong in the ordinance as the City is not the enforcing agency on wetland alterations. If <br />it is referring to alteration of wetland buffers, then maybe it should remain in the ordinance. <br /> <br />9.26.02, Subd. 2.h - Eliminate this sentence as the subject matter is the purpose of the <br />Environmental Policy Board and does not need to be re-stated in this ordinance. Chairperson <br />McDilda to draft a new "h" that will address monitoring and water quality aspects of the <br />inventoried wetlands. <br /> <br />9.26.03, Subd. 1.b - Fourth sentence - remove the words 'presence or'. City Staff to make sure <br />this section does not conflict with 9.02 (definitions) and 9.50 (subdivision requirements) of City <br />Code. Also need a discussion with the consultant regarding the intent of this section. <br /> <br />9.26.03, Subd. 1.e - Come back and review this section again when all members have a copy of <br />the WCA exemptions. <br /> <br />9.26.03, Subd. 1.f- Correct typo and change 'form' to 'from'. <br /> <br />9.26.04, Subd. 1 - Staff member Chris Anderson directed to review this section to make sure it <br />does not conflict with septic system regulations. <br /> <br />9.26.04, Subd. 2 - Should be changed to read as follows: 'The MPCA's Best Management <br />Practices shall be followed for the construction of wetland protection methods and related <br />improvements.' <br /> <br />9.26.05, Subd. 1 - Change the second sentence to read as follows: 'The setback and buffer <br />provisions shall also apply to lots of record created prior to the date of this ordinance, for which <br />conditional use permits, site plans, preliminary plats, final plats or preliminary or final planned <br />unit development plans have been approved.' <br /> <br />9.26.05, Subd. 2 - Mr. Max was directed to re-write this section to reflect the following <br />thoughts: 'For parcels of land adjacent to a wetland inventory area but are not entirely on the <br />Developer's property, the buffering shall be of a preserve quality unless otherwise demonstrated <br />by the Developer.' <br /> <br />It is noted that there needs to be a definition of 'delineation' in the ordinance. <br /> <br />EPTF February 14, 2005 <br /> Page 3 of 4 <br /> <br /> <br />
