Voting Yes: Chairperson McDilda, Committee Members Olds, Sitiz and Bauer. <br />Voting No: None. Absent: Committee Member Connolly and Max. <br /> <br />Chairperson McDilda stated that he would also be contacting Mr. Max regarding information <br />needed to go forward so that the matter will not have to be tabled entirely until the next <br />meeting. <br /> <br />A discussion ensued regarding the fact that as drafted, this ordinance would come into play even <br />if a homeowner was just applying for a building permit to build a shed in their back yard. The <br />requirements to delineate wetlands and establish, seed and sign a buffer strip are excessive for <br />an individual that is just applying for a building permit for a structure. It is also not logical to <br />create sporadic wetland buffers as individuals make changes to their parcels. <br /> <br />Also, there are subdivisions that will be approved and in the process of developing when this <br />ordinance takes effect. The lots developed prior to the ordinance will not be subject to the <br />wetland buffer ordinance; building permits applied for after the ordinance becomes effective <br />will be subject to the ordinance. This again creates sporadic buffers within a neighborhood. <br /> <br />Consensus was that the most fair and equitable application of the ordinance would be to apply it <br />to all subdivision applications after a date certain and and exempt all previously approved plats. <br />As for individual property owners, the best solution may be to implement a setback from <br />wetlands so that the individual homeowner is not adversely impacted by the buffer ordinance <br />but steps are taken to preserve an area for a future buffer. <br /> <br />Case #3: Request For Leave Of Absence <br /> <br />EPTF March 7, 2005 <br />Page 5 of 6 <br /> <br /> <br />
