HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />41.1 (b) If the office receives an application that fails to provide the required information, <br />41.2 the office shall issue a deficiency notice to the applicant. The applicant shall have ten <br />41.3 business days from the date of the deficiency notice to submit the required information. <br />41.4 (c) Failure by an applicant to submit all required information will result in the application <br />41.5 being rejected. <br />41.6 (d) Upon receipt of a completed application and fee, the office shall forward a copy of <br />41.7 the application to the local unit of Lyovernment in which the business oDerates or intends to <br />41.8 operate with a form for certification as to whether a proposed cannabis business or hemp <br />41.9 business complies with local zoning ordinances and, if applicable, whether the proposed <br />41.io business complies with the state fire code and building code. <br />41.11 (e) Within 90 days of receiving a completed application and the results of anv reauired <br />41.12 criminal history check, the office shall issue the appropriate license or send the applicant a <br />41.13 notice of rejection setting forth specific reasons that the office did not approve the application. <br />41.14 Sec. 15. [342.15] ADULT -USE CANNABIS BUSINESS; CRIMINAL HISTORY <br />41.15 CHECK AND DISQUALIFICATIONS. <br />41.16 Subdivision 1. Criminal history check. (a) Upon request by the office, every applicant <br />41.17 for a cannabis business license and DrosDective cannabis worker must submit a completed <br />41.18 criminal history records check consent form, a full set of classifiable fingerprints, and the <br />41.19 required fees to the office. Upon receipt of this information, the office must submit the <br />41.20 completed criminal history records check consent form, full set of classifiable fingerprints, <br />41.21 and required fees to the Bureau of Criminal Apprehension. After receiving this information, <br />41.22 the bureau must conduct a Minnesota criminal history records check of the license applicant <br />41.23 or prospective cannabis worker. The bureau may exchange a license applicant's or prospective <br />41.24 cannabis worker's fingerprints with the Federal Bureau of Investigation to obtain the license <br />41.25 applicant's or prospective cannabis worker's national criminal history record information. <br />41.26 The bureau must return the results of the Minnesota and federal criminal history records <br />41.27 checks to the director to determine if the license applicant or prospective cannabis worker <br />41.28 is disqualified under rules adopted pursuant to this section. <br />41.29 (b) The office may, by rule, establish exceptions to the requirement under paragraph (a) <br />41.30 for members of a cooperative who hold less than a five percent ownership interest in the <br />41.31 cooperative. <br />41.32 Subd. 2. Criminal offenses; disqualifications.
