In adopting rules pursuant to this subdivision, the office shall <br />42.3 not disqualify a person for a violation of section 152.025. <br />42.4 Subd. 3. Risk of harm; set aside. The office may set aside a disqualification under <br />42.5 subdivision 2 if the office finds that the person has submitted sufficient information to <br />42.6 demonstrate that the person does not pose a risk of harm to any person served by the <br />42.7 applicant, license holder, or other entities as provided in this chapter. <br />42.8 Subd. 4. Exception. The background check requirements and disqualifications under <br />42.9 this section do not apply to an applicant for a hemp business license or to hemp workers. <br />42.10 Sec. 16. [342.16] CANNABIS BUSINESSES; GENERAL OWNERSHIP <br />42.11 DISQUALIFICATIONS AND REQUIREMENTS. <br />42.12 (a) A license holder or applicant must meet each of the following requirements, if <br />42.13 applicable, to hold or receive a cannabis license issued under this chapter: <br />42.14 (1) be at least 21 years of age; <br />42.15 (2) have completed an application for licensure or application for renewal; <br />42.16 (3) have paid the applicable application fee and license fee; <br />42.17 (4) reside in the state; <br />42.18 (5) if the applicant or license holder is a business entity, be incorporated in the state or <br />42.19 otherwise formed or organized under the laws of the state; <br />42.20 (6) if the applicant or license holder is a business entity, at least 75 percent of the business <br />42.21 must be owned by Minnesota residents; <br />42.22 (7) not be employed by the office or any state agency with regulatory authority under <br />42.23 this chapter or the rules adopted pursuant to this chapter; <br />42.24 (8) not be a licensed peace officer, as defined in section 626.84, subdivision 1, paragraph <br />42.25 C , <br />42.26 (9) never have had a license previously issued under this chapter revoked; <br />42.27 (10) have filed any previously required tax returns for a cannabis business; <br />42.28 (11) have paid and remitted any business taxes, gross receipts taxes, interest, or penalties <br />42.29 due relating to the operation of a cannabis business; <br />Article 1 Sec. 16. 42 <br />
