HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />45.1 (b) The office may award additional points to an application if the license holder would <br />45.2 expand service to an underrepresented market including but not limited to participation in <br />45.3 the medical cannabis program. <br />45.4 (c) The office shall establish application materials permitting individual applicants to <br />45.5 demonstrate the impact that cannabis prohibition has had on that applicant including but <br />45.6 not limited to the arrest or imprisonment of the applicant or a member of the applicant's <br />45.7 immediate family, and the office may award points to such applicants in the same manner <br />45.8 as points are awarded to social equity applicants. <br />45.9 (d) The office shall establish policies and guidelines, which shall be made available to <br />45.10 the public, regarding the number of points available in each category and the basis for <br />45.11 awarding those points. Status as a social equity applicant must account for at least 20 percent <br />45.12 of the total available points. In determining the number of points to award to a cooperative <br />45.13 or business applying as a social equity applicant, the office shall consider the number or <br />45.14 ownership percentage of cooperative members, officers, directors, managers, and general <br />45.15 partners who qualify as social equity applicants. <br />45.16 (e) Consistent with the goals identified in subdivision 1, the office shall issue licenses <br />45.17 in each license category, giving priority to applicants who receive the highest score under <br />45.18 paragraphs (a) and (b). If there are insufficient licenses available for entities that receive <br />45.19 identical scores, the office shall utilize a lottery to randomly select license recipients from <br />45.20 among those entities. <br />45.21 Sec. 19. [342.19] INSPECTION; LICENSE VIOLATIONS; PENALTIES. <br />45.22 Subdivision 1. Authority to inspect. (a) In order to carry out the purposes of this chapter, <br />45.23 the office, upon presenting appropriate credentials to the owner, operator, or agent in charge, <br />45.24 is authorized to: <br />45.25 (1) enter any cannabis business or hemp business without delay and at reasonable times; <br />45.26 (2) inspect and investigate during regular working hours and at other reasonable times, <br />45.27 within reasonable limits and in a reasonable manner, anv cannabis business or hemb business <br />45.28 and all relevant conditions, equipment, records, and materials therein; and <br />45.29 (3) question privately any employer, owner, operator, agent, or employee of a cannabis <br />45.30 business or hemp business. <br />45.31 (b) An employer, owner, operator, agent, or employee must not refuse the office entry <br />45.32 or otherwise deter or prohibit the office from taking action under paragraph (a). <br />Article 1 Sec. 19. 45 <br />
