HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />44.1 (5) a resident for the last five years of one or more census tracts where, as reported in <br />44.2 the most recently completed decennial census published by the United States Bureau of the <br />44.3 Census, either: <br />44.4 (i) the poverty rate was 20 percent or more; or <br />44.5 (ii) the median family income did not exceed 80 percent of statewide median family <br />44.6 income or, if in a metropolitan area, did not exceed the greater of 80 percent of the statewide <br />44.7 median family income or 80 percent of the median family income for that metropolitan <br />44.8 area. <br />44.9 Sec. 18. [342.18] LICENSE SELECTION CRITERIA. <br />44.10 Subdivision 1. Market stability. The office shall issue the necessary number of licenses <br />44.11 in order to ensure the sufficient supply of cannabis flower and cannabis products to meet <br />44.12 demand, provide market stability, ensure a competitive market, and limit the sale of <br />44.13 unregulated cannabis flower and cannabis products. <br />44.14 Subd. 2. Vertical integration prohibited; exceptions. (a) Except as otherwise provided <br />44.15 in this subdivision, the office shall not issue licenses to a single applicant that would result <br />44.16 in the applicant being vertically integrated in violation of the provisions of this chapter. <br />44.17 (b) Nothing in this section prohibits or limits the issuance of microbusiness licenses or <br />44.18 mezzobusiness licenses, or the issuance of both lower -potency hemp edible manufacturer <br />44.19 and lower -potency hemp edible retailer licenses to the same person or entity. <br />44.20 Subd. 3. Application score; license priority. (a) The office shall award points to each <br />44.21 completed application for a license to operate a cannabis business in the following categories: <br />44.22 (1) status as a social equity applicant or as an applicant who is substantially similar to <br />44.23 a social equity applicant as described in paragraph (c); <br />44.24 (2) status as a veteran or retired national guard applicant who does not meet the definition <br />44.25 of social equity applicant; <br />44.26 (3) security and record keeping; <br />44.27 (4) employee training plan; <br />44.28 (5) business plan and financial situation; <br />44.29 (6) labor and employment practices; <br />44.30 (7) knowledge and experience; and <br />44.31 (8) environmental plan. <br />Article 1 Sec. 18. 44 <br />
