HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />49.1 (b) For each violation of this chapter or rules adopted pursuant to this chapter, the office <br />49.2 may issue to each cannabis business or hemp business a monetary penalty of up to $10,000, <br />49.3 an amount that deprives the business of any economic advantage gained by the violation, <br />49.4 or both. <br />49.5 (c) An administrative penalty may be recovered in a civil action in the name of the state <br />49.6 brought in the district court of the county where the violation is alleged to have occurred <br />49.7 or the district court where the office is housed. <br />49.8 (d) In addition to penalties listed in this subdivision, a person or business who violates <br />49.9 the provisions of this chapter is subject to any applicable criminal penalty. <br />49.10 Sec. 20. [342.201 DATA PRACTICES. <br />49.11 Subdivision 1. Not public data. The following data collected, created, or maintained <br />49.12 by the office are classified as nonpublic data, as defined by section 13.02, subdivision 9, or <br />49.13 as private data on individuals, as defined by section 13.02, subdivision 12: <br />49.14 (1) application data submitted by an applicant for a cannabis business license or hemp <br />49.15 business license, other than the data listed in subdivision 2; <br />49.16 (2) the identity of a complainant who has made a report concerning a license holder or <br />49.17 applicant that appears in inactive complaint data unless the complainant consents to the <br />49.18 disclosure; <br />49.19 (3) the nature or content of unsubstantiated complaints when the information is not <br />49.20 maintained in anticipation of legal action; <br />49.21 (4) the record of any disciplinary proceeding except as limited by subdivision 9; <br />49.22 (5) data identifying retail or wholesale customers of a cannabis business or hemp business; <br />49.23 and <br />49.24 (6) data identifying cannabis workers or hemp workers. <br />49.25 Subd. 2. Public data on license applicants. (a) The following application data submitted <br />49.26 by an applicant for a cannabis business license or hemp business license are bublic data: <br />49.27 (1) the applicant's name and designated address; <br />49.28 (2) data disclosing the ownership and control of the applicant; <br />49.29 (3) proof of trade name registration; <br />49.30 (4) data showing the legal possession of the premises where the business will operate; <br />Article 1 Sec. 20. 49 <br />
