HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />50.1 (5) data describing whether volatile chemicals will be used in any methods of extraction <br />50.2 or concentration; <br />50.3 (6) environmental plans; <br />50.4 (7) the type and number of other cannabis business licenses or hemp business licenses <br />50.5 held by the applicant; and <br />50.6 (8) the name, address, location, dates, and hours of where any proposed cannabis event <br />50.7 will take place. <br />50.8 (b) Scoring and other data generated by the office in its review of an applicant for a <br />50.9 cannabis business license or hemp business license are bublic data. <br />50.10 Subd. 3. Public application data on license holders. Once an applicant for a cannabis <br />50.11 business license or hemp business license becomes a license holder, all of the application <br />50.12 data that the license holder had previously submitted to the office are public data except <br />50.13 that the following data remain classified as nonpublic data or private data on individuals: <br />50.14 (1) data identifying retail or wholesale customers of a cannabis business or hemp business; <br />50.15 (2) data identifying cannabis workers or hemp workers; <br />50.16 (3) tax returns, bank account statements, and other financial account information; <br />50.17 (4) business plans; and <br />50.18 (5) security information and trade secret information, as defined by section 13.37. <br />50.19 Subd. 4. Public disciplinary data. Minutes, orders for hearings, findings of fact, <br />50.20 conclusions of law, and specification of the final disciplinary action contained in the record <br />50.21 of the disciplinary action are classified as public data. If there is a public hearing concerning <br />50.22 the disciplinary action, the entire record concerning the disciplinary action is public data. <br />50.23 If the license holder and the office agree to resolve a complaint without a hearing, the <br />50.24 agreement and the specific reasons for the agreement are public data. <br />50.25 Subd. 5. Data practices administration. (a) The office must establish written procedures <br />50.26 to ensure that only individuals authorized by law may enter, update, or access data maintained <br />50.27 by the office and classified as nonpublic or private data on individuals. An authorized <br />50.28 individual's ability to enter, update, or access not public data must correspond to the official <br />50.29 duties or training level of the individual and to the statutory authorization granting access <br />50.30 for that purpose. All queries and responses, and all actions in which not public data are <br />50.31 entered, updated, accessed, shared, or disseminated, must be recorded in a data audit trail. <br />Article 1 Sec. 20. 50 <br />
