HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />51.1 Data contained in the audit trail have the same classification as the underlying data tracked <br />51.2 by the audit trail. <br />51.3 (b) The office must not share data classified as nonpublic or private data on individuals <br />51.4 under this section or other data identifying an individual applicant or license holder with <br />51.5 any federal agency, federal department, or federal entity unless specifically ordered to do <br />51.6 so by a state or federal court. <br />51.E (c) The office must arrange for an independent audit to verify compliance with this <br />51.8 section. The audit must be completed annually for the first two years following establishment <br />51.9 of the office and biennially thereafter. The results of the audit are public. No later than 30 <br />51.10 days following completion of the audit, the office must provide a report summarizing the <br />51.11 audit results to the chairs and ranking minority members of the committees and divisions <br />51.12 of the house of representatives and the senate with iurisdiction over commerce and data <br />51.13 practices, and the Legislative Commission on Data Practices and Personal Data Privacy. <br />51.14 The report must be submitted as required under section 3.195, except that printed copies <br />51.15 are not required. <br />51.16 Sec. 21. [342.21] LICENSE SUSPENSION OR REVOCATION; HEARING. <br />51.17 Subdivision 1. License revocation and nonrenewal. The office may revoke or not <br />51. i g renew a license when the office has cause to believe that a cannabis business or hemp <br />51. i 9 business has violated an ownership or operational requirement in this chapter or rules adopted <br />51.20 pursuant to this chapter. The office must notify the license holder in writing, specifying the <br />51.21 Lyrounds for revocation or nonrenewal and fixinLy a time of at least 20 days thereafter for a <br />51.22 hearing on the matter. <br />51.23 Subd. 2. Hearing; written findings. (a) Before the office revokes or does not renew a <br />51.24 license, the office must provide the license holder with a statement of the complaints made <br />51.25 against the license holder, and the office must hold a hearing to determine whether the office <br />51.26 should revoke the license or deny renewal of the license. The license holder shall receive <br />51.27 notice at least 20 days before the date of the hearing and notice may be served either by <br />51.28 certified mail addressed to the address of the license holder as shown in the license <br />51.29 application or in the manner provided by law for the service of a summons. At the time and <br />51.30 place fixed for the hearing, the office, or any office employee or agent authorized by the <br />51.31 office to conduct the hearing, shall receive evidence, administer oaths, and examine witnesses. <br />51.32 (b) After the hearing held pursuant to paragraph (a), or upon the failure of the license <br />51.33 holder to appear at the hearing, the office must take action as is deemed advisable and issue <br />Article 1 Sec. 21. 51 <br />
