HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />59.1 Sec. 25. [342.25] CULTIVATION OF CANNABIS; GENERAL REQUIREMENTS. <br />59.2 Subdivision 1. Applicability. Every cannabis business with a license or endorsement <br />59.3 authorizing the cultivation of cannabis must comply with the requirements of this section. <br />59.4 Subd. 2. Cultivation records. A business licensed or authorized to cultivate cannabis <br />59.5 must prepare a cultivation record for each batch of cannabis plants and cannabis flower in <br />59.6 the form required by the office and must maintain each record for at least five years. The <br />59.E cultivation record must include the quantity and timing, where applicable, of each pesticide, <br />59.8 fertilizer, soil amendment, or plant amendment used to cultivate the batch, as well as any <br />59.9 other information required by the office in rule. The cannabis business must present <br />59.10 cultivation records to the office, the commissioner of agriculture, or the commissioner of <br />59.11 health upon request. <br />59.12 Subd. 3. Agricultural chemicals and other inputs. A business licensed or authorized <br />59.13 to cultivate cannabis is subject to rules promulgated by the office governing the use of <br />59.14 pesticides, fertilizers, soil amendments, plant amendments, and other inputs to cultivate <br />59.15 cannabis. <br />59.16 Subd. 4. Cultivation plan. A business licensed or authorized to cultivate cannabis must <br />59.17 prepare, maintain, and execute an operating plan and a cultivation plan as directed by the <br />59.18 office in rule, which must include but is not limited to: <br />59.19 (1) water usage; <br />59.20 (2) recycling; <br />59.21 (3) solid waste disposal; and <br />59.22 (4) a pest management protocol that incorporates integrated pest management principles <br />59.23 to control or prevent the introduction of bests to the cultivation site. <br />59.24 Subd. 5. Pesticides; pollinator protection. (a) A business licensed or authorized to <br />59.25 cultivate cannabis must comply with chapters 18B, 18D, 18E, and any other pesticide laws <br />59.26 and rules enforced by the commissioner of agriculture. <br />59.27 (b) A business licensed or authorized to cultivate cannabis must not apply pesticides <br />59.28 when pollinators are present or allow pesticides to drift to flowering plants that are attractive <br />59.29 to pollinators. <br />59.30 Subd. 6. Adulteration prohibited. A business licensed or authorized to cultivate cannabis <br />59.31 must not treat or otherwise adulterate cannabis plants or cannabis flower with any substance <br />Article 1 Sec. 25. 59 <br />
