HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />95.1 Subd. 2. All manufacturer operations. (a) All hemp manufacturing must take place in <br />95.2 a facility and on equipment that meets the applicable health and safety requirements <br />95.3 established by the office, including requirements for cleaning and testing machinery between <br />95.4 production of different products. <br />95.5 (b) A lower -potency hemp edible manufacturer must comply with all applicable <br />95.6 packaging, labeling, and testing requirements. <br />95.7 Subd. 3. Extraction and concentration. (a) A lower -potency hemp edible manufacturer <br />95.8 that creates hemp concentrate or artificially derived cannabinoids must obtain an endorsement <br />95.9 from the office. <br />95.10 (b) A lower-Dotencv hemD edible manufacturer seeking an endorsement to create hem <br />95.11 concentrate must inform the office of all methods of extraction and concentration that the <br />95.12 manufacturer intends to use and identify the volatile chemicals, if any, that will be involved <br />95.13 in the creation of hemp concentrate. A lower -potency he edible manufacturer may not <br />95.14 use a method of extraction and concentration or a volatile chemical without aDDroval by <br />95.15 the office. <br />95.16 (c) A lower-Dotencv hemD edible manufacturer seeking an endorsement to create <br />95.17 artificially derived cannabinoids must inform the office of all methods of conversion that <br />95.18 the manufacturer will use, including any specific catalysts that the manufacturer will employ, <br />95.19 to create artificially derived cannabinoids and the molecular nomenclature of all cannabinoids <br />95.20 or other chemical compounds that the manufacturer will create. A business licensed or <br />95.21 authorized to manufacture lower-Dotencv hemD edibles may not use a method of conversion <br />95.22 or a catalyst without approval by the office. <br />95.23 (d) A lower -potency hemp edible manufacturer must obtain a certification from an <br />95.24 independent third -party industrial hygienist or professional engineer approving: <br />95.25 (1) all electrical, gas, fire suppression, and exhaust systems; and <br />95.26 (2) the plan for safe storage and disposal of hazardous substances, including but not <br />95.27 limited to any volatile chemicals. <br />95.28 (e) Upon the sale of hemp concentrate or artificially derived cannabinoids to any person, <br />95.29 cooperative, or business, a lower -potency hemp edible manufacturer must provide a statement <br />95.30 to the buyer that discloses the method of extraction and concentration or conversion used <br />95.31 and any solvents, gases, or catalysts, including but not limited to any volatile chemicals <br />95.32 involved in that method. <br />Article 1 Sec. 45. 95 <br />
