HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />117.1 Sec. 57. [342.57] PROTECTIONS FOR REGISTRY PROGRAM PARTICIPANTS. <br />117.2 Subdivision 1. Presumption. There is a presumption that a patient enrolled in the registry <br />117.3 program is engaged in the authorized use of medical cannabis flower and medical cannabinoid <br />117.4 products. This presumption may be rebutted by evidence that the patient's use of medical <br />117.5 cannabis flower or medical cannabinoid products was not for the Duraose of treating or <br />117.6 alleviating the patient's qualifying medical condition or symptoms associated with the <br />117.7 patient's qualifying medical condition. <br />117.8 Subd. 2. Criminal and civil protections. (a) Subject to section 342.56, the following <br />117.9 are not violations of this chapter or chapter 152: <br />117.10 (1) use or possession of medical cannabis flower, medical cannabinoid products, or <br />117.11 medical cannabis paraphernalia by a patient enrolled in the registry program or by a visiting <br />117.12 patient to whom medical cannabis flower or medical cannabinoid Droducts are distributed <br />117.13 under section 342.51, subdivision 5; <br />117.14 (2) Dossession of medical cannabis flower. medical cannabinoid products. or medical <br />117.15 cannabis paraphernalia by a registered designated caregiver or a parent, legal guardian, or <br />117.16 spouse of a patient enrolled in the registry program; or <br />117.17 (3) possession of medical cannabis flower, medical cannabinoid products, or medical <br />117.18 cannabis paraphernalia by any person while carrying out duties required under sections <br />117. i 9 342.47 to 342.60. <br />117.20 (b) The Office of Cannabis Management, members of the Cannabis Advisory Council, <br />117.21 Office of Cannabis Management employees, agents or contractors of the Office of Cannabis <br />117.22 Management, and health care practitioners participating in the registry program are not <br />117.23 subject to any civil penalties or disciplinary action by the Board of Medical Practice, the <br />117.24 Board of Nursing, or any business, occupational, or professional licensing board or entity <br />117.25 solely for participating in the registry program either in a professional capacity or as a <br />117.26 patient. A pharmacist licensed under chapter 151 is not subject to any civil penalties or <br />117.27 disciplinary action by the Board of Pharmacy when acting in accordance with sections <br />117.28 342.47 to 342.60 either in a professional capacity or as a patient. Nothing in this section <br />117.29 prohibits a professional licensing board from taking action in response to a violation of law. <br />117.30 (c) Notwithstanding any law to the contrary, a Cannabis Advisory Council member, the <br />117.31 governor, or an employee of a state agency must not be held civilly or criminally liable for <br />117.32 any injury, loss of property, personal injury, or death caused by any act or omission while <br />117.33 acting within the scope of office or emDlovment under sections 342.47 to 342.60. <br />Article 1 Sec. 57. 117 <br />
