This section is effective January 1, 2024. <br />120.5 Sec. 59. [342.59] DATA PRACTICES. <br />120.6 Subdivision 1. Data classification. Patient health records maintained by the Office of <br />120.E Cannabis Management or the Division of Medical Cannabis and government data in patient <br />120.8 health records maintained by a health care practitioner are classified as private data on <br />120.9 individuals, as defined in section 13.02, subdivision 12, or nonpublic data, as defined in <br />120.10 section 13.02, subdivision 9. <br />120.11 Subd. 2. Allowable use; prohibited use. Data specified in subdivision 1 may be used <br />120.12 to comply with chapter 13, to comply with a request from the legislative auditor or the state <br />120.13 auditor in the performance of official duties, and for purposes specified in sections 342.47 <br />120.14 to 342.60. Data specified in subdivision 1 and maintained by the Office of Cannabis <br />120.15 Management or Division of Medical Cannabis must not be used for any purpose not specified <br />120.16 in sections 342.47 to 342.60 and must not be combined or linked in any manner with any <br />120.17 other list, dataset, or database. Data specified in subdivision 1 must not be shared with any <br />120.18 federal agency, federal department, or federal entity unless specifically ordered to do so by <br />120.19 a state or federal court. <br />120.20 EFFECTIVE DATE. This section is effective January 1, 2024. <br />120.21 Sec. 60. [342.60] CLINICAL TRIALS. <br />120.22 The Division of Medical Cannabis may conduct, or award grants to health care providers <br />120.23 or research organizations to conduct, clinical trials on the safety and efficacy of using <br />120.24 medical cannabis flower or medical cannabinoid products to treat a specific health condition. <br />120.25 A health care provider or research organization receiving a grant under this section must <br />120.26 provide the office with access to all data collected in a clinical trial funded under this section. <br />120.27 The office may use data from clinical trials conducted or funded under this section as <br />120.28 evidence to approve additional qualifying medical conditions or additional allowable forms <br />120.29 of medical cannabis. <br />120.30 EFFECTIVE DATE.
