HF100 NINTH ENGROSSMENT REVISOR BD 1­10100-9 <br />121.1 Sec. 61. [342.61] TESTING. <br />121.2 Subdivision 1. Testing required. Cannabis businesses and hemp businesses shall not <br />121.3 sell or offer for sale cannabis flower, cannabis products, artificially derived cannabinoids, <br />121.4 lower -potency hemp edibles, or hemp -derived consumer products to another cannabis <br />121.5 business or hemp business, or to a customer or patient, or otherwise transfer cannabis flower, <br />121.6 cannabis products, artificially derived cannabinoids, lower -potency hemp edibles, or <br />121.7 hemp -derived consumer products to another cannabis business or hemp business, unless: <br />121.8 (1) a representative sample of the batch of cannabis flower, cannabis products, artificially <br />121.9 derived cannabinoids, lower -potency he edibles, or hemp -derived consumer products <br />121i o has been tested according to this section and rules adopted under this chapter; <br />121.11 (2) the testing was completed by a cannabis testing facility licensed under this chapter; <br />121.12 and <br />121.13 (3) the tested sample of cannabis flower, cannabis products, artificially derived <br />121.14 cannabinoids, lower -potency hemp edibles, or hemp -derived consumer products was found <br />121.15 to meet testing standards established by the office. <br />121.16 Subd. 2. Procedures and standards established by office. (a) The office shall by rule <br />121.17 establish procedures governing the sampling, handling, testing, storage, and transportation <br />121.18 of cannabis flower, cannabis products, artificially derived cannabinoids, lower -potency <br />121. i 9 hemp edibles, or hemp -derived consumer products tested under this section; the contaminants <br />121.20 for which cannabis flower, cannabis products, artificially derived cannabinoids, <br />121.21 lower -potency hemp edibles, or hemp -derived consumer products must be tested; standards <br />121.22 for potency and homogeneity testing; and procedures applicable to cannabis businesses, <br />121.23 hemp businesses, and cannabis testing facilities regarding cannabis flower, cannabis products, <br />121.24 artificially derived cannabinoids, lower -potency hemp edibles, or hemp -derived consumer <br />121.25 products that fail to meet the standards for allowable levels of contaminants established by <br />121.26 the office, that fail to meet the potency limits in this chapter, or that do not conform with <br />121.27 the content of the cannabinoid profile listed on the label. <br />121.28 (b) All testing required under this section must be performed in a manner that is consistent <br />121.29 with general requirements for testing and calibration activities. <br />121.30 Subd. 3. Standards established by Office of Cannabis Management. The office shall <br />121.31 by rule establish standards for allowable levels of contaminants in cannabis flower, cannabis <br />121.32 products, artificially derived cannabinoids, lower -potency hemp edibles, or hemp -derived <br />121.33 consumer products, and growing media.
