HF100 NINTH ENGROSSMENT REVISOR BD 1­10100-9 <br />122.1 allowable levels must include but are not limited to residual solvents, foreign material, <br />122.2 microbiological contaminants, heavy metals, pesticide residue, and mycotoxins. <br />122.3 Subd. 4. Testing of samples; disclosures. (a) On a schedule determined by the office, <br />122.4 every cannabis microbusiness, cannabis mezzobusiness, cannabis cultivator, cannabis <br />122.5 manufacturer, cannabis wholesaler with an endorsement to import products, lower -potency <br />122.6 hemp edible manufacturer, medical cannabis cultivator, or medical cannabis processor shall <br />122.7 make each batch of cannabis flower, cannabis products, artificially derived cannabinoids, <br />122.9 lower -potency hemp edibles, or hemp -derived consumer products grown, manufactured, or <br />122.9 imported by the cannabis business or hemp business available to a cannabis testing facility. <br />122.10 (b) A cannabis microbusiness, cannabis mezzobusiness, cannabis cultivator, cannabis <br />122.11 manufacturer, cannabis wholesaler with an endorsement to import products, lower -potency <br />122.12 hemp edible manufacturer, medical cannabis cultivator, or medical cannabis processor must <br />122.13 disclose all known information regarding pesticides, fertilizers, solvents, or other for <br />122.14 materials, including but not limited to catalysts used in creating artificially derived <br />122.15 cannabinoids, applied or added to the batch of cannabis flower, cannabis products, artificially <br />122.16 derived cannabinoids, lower -potency he edibles, or hemp -derived consumer products <br />122.17 subject to testing. Disclosure must be made to the cannabis testing facility and must include <br />122.18 information about all applications by any person, whether intentional or accidental. <br />122.19 (c) The cannabis testing facility shall select one or more representative samples from <br />122.2o each batch, test the samples for the presence of contaminants, and test the samples for <br />122.21 potency and homogeneity and to allow the cannabis flower, cannabis product, artificially <br />122.22 derived cannabinoid, lower -potency hemp edible, or hemp -derived consumer product to be <br />122.23 accurately labeled with its cannabinoid profile. Testing for contaminants must include testing <br />122.24 for residual solvents, foreign material, microbiological contaminants, heavy metals, pesticide <br />122.25 residue, mycotoxins, and any items identified pursuant to paragraph (b), and may include <br />122.26 testing for other contaminants. A cannabis testing facility must destroy or return to the <br />122.27 cannabis business or hem-D business anv -Dart of the sam-Dle that remains after testing. <br />122.28 Subd. 5. Test results. (a) If a sample meets the applicable testing standards, a cannabis <br />122.29 testing facility shall issue a certification to a cannabis microbusiness, cannabis <br />122.30 mezzobusiness, cannabis cultivator, cannabis manufacturer, cannabis wholesaler with an <br />122.31 endorsement to import products, lower -potency hemp edible manufacturer, medical cannabis <br />122.32 cultivator, or medical cannabis processor, and the cannabis business or hemp business may <br />122.33 then sell or transfer the batch of cannabis flower, cannabis products, artificially derived <br />122.34 cannabinoids, lower -potency hemp edibles, or hemp -derived consumer products from which <br />122.35 the sample was taken to another cannabis business or hemp business, or offer the cannabis <br />Article 1 Sec. 61. 122 <br />
